parking charge which I am ignoring

Just wanted to doublecheck Im doing things correctly.
I received a parking fine through post for cp plus ltd as I had parked longer than the free time allowed in a motorway service station. I ignored the 3 letters they sent me, and now on the 2nd from debt recovery plus. The last one was notice of intended litigation. I have absolutely no intention of paying anything as I feel their charges are totally unjustified, just wondered how much longer the letters will continue. Cp plus have never even asked who the diver was. I am actually more than happy to go to court but assume this is just a scare tactic?
just wanted a little bit of advice as to how much longer this may continue?

    Yes, it is simply a scare tactic- which obviously is not working on you, well done!

    If you have not replied at all (well done!) then the threat to take you to court ("litigation") is utterly meaningless as the first thing they would need to prove is who was driving the car- impossible if no-one tells them.

    If you actually want a day in court, there is nothing to stop you suing THEM for harassment- unlike them, you will actually have a case. Though this would mean breaking your silence.

    Up to you. If not, just keep doing what you are doing. Soon they will realise they are wasting their time and money and go looking for someone who might give a damn about their empty threats.

    Was this an underwater car park then?

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.
  • ive just had a look at the sample letters and mine are definately running to form, quite fun to read really! I am not very good at understanding all processes with legitimate bills etc, but my understanding was if you didnt a pay a company for goods, etc, they could sell the debt onto the debt agencies and the debt becomes theirs. Is that what has happened here or are CP plus scamming and pretending they are debt recovery?

    No the debt won't have been sold because it isn't a debt! It would only be a debt if they were awarded it in court and as you realise that won't happen.

    The "debt collection agency" is as phoney as the car parking company, it has absolutely zero powers so it can/will do nothing. Just part of the overall scam.

    Except give up when you get to the end of the letter chain.

    By the way, don't forget to tell all of your friends what to do if they get one of these FAKE tickets from this or any other private company. Only GENUINE tickets from a Council or the Police need to be dealt with!
