Who to claim whiplash from?
Friend had a car accident. She was rear ended and has suffered whiplash. The car is a write off. She plans to ring the insurance company tomorrow. Her friend told her to approach one of those claims direct type of company instead because they will help claim for whiplash.
I have told her that she needs to contact her insurance company herself. If she has legal cover then they will help claim for whiplash. Whatever compensation she is awarded she will get all of it. If she went to these claims direct company then they might take a percentage of the compenstation for their fees or something similar.
I did however told her that i will check with my learned friends here and see what is the best step to take.
What do you recommend?

I had a similar experience and claim was settled with the other person's insurance not mine!!! It wasn't my faultGo hopefully into each new day, enjoy something from every day no matter how small, you never know when it will be your last0

Her own insurance should be dealing with this as part of the claim against the other insurance company.Lost my soulmate so life is empty.
I can bear pain myself, he said softly, but I couldna bear yours. That would take more strength than I have -

I am very surprised that she was not contacted about an 1 hour after she got in touch with her own insurance company. They get commission as part of their 'ambulance chasing' solicitors. Good Luck!!0

I thought that was being stopped?
BTW the injury claim is for "losses incurred", not for "ouch my neck hurts"..... So a lot depends on what this injury is costing your friend.“I may not agree with you, but I will defend to the death your right to make an a** of yourself.”

Your friend can cut out her insurer getting paud a commission to pass on her details to a PI lawyer and get paid a commission herself!
Google cashback personal injury solicitors. £300 to £500 is not unusual. (They have to pay the insurers much more!)0 -
Love all these replies.
It is the use of these claims firms and agents that is costing us all massively.
Submit claim through her own insurance and "leagal" protection cover. that is what we pay our premiums for. Not to feed a pack of rabid parasites.
By the way - who has confirmed the car is a write off and who has diagnosed whiplash - may well be something more serious if the collision was so serious."If you act like an illiterate man, your learning will never stop... Being uneducated, you have no fear of the future.".....

Rear-ending and whip lash injury- such an easy (and lucrative) way to claim for often spurious injuries.0

Following your advice won't save the rest of us anything on premiums!!
The insurer will still want (and get) a high commission from the solicitor they pass this on to!0 -

And it is the insurance companies who are feeding the "rabid parasites". There have been reductions in total claims values but our darling insurers continue to push up the premiums. My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
