    Chemer,

Ignore the troll at post #9, he's from a PPC and wouldn't recognise reality if it slapped him in the face.

What Kite says. Cheers Kite, you beat me to it.

    ppeterson is a PPC TROLL!!!

Do not think he is a genuine giver of advice. He is here purely to promote THEIR interests!

    be warned.

    What a load of tosh

You are agreeing by your actions, UCTA does not play any part where the charge is a core contract term (see bank charges ruling if you need further guidance)

    The charge is clearly stated, <4hrs = Free .. >4Hrs = Charge

The payment mechanism is the charge notice/invoice (do you have to put 50p in your mobile phone when you make a call .. of course not, you get invoiced for it later)
Your reasoning is fine and dandy, it is the charge itself that is the problem, as £80 is excessive and it would be difficult to justify in court even if a contract was proved to exist, maybe a tenner would be a reasonable, charge, but not 80 quid!

Banik charges are different as this was a contact that was entered into and signed for, not merely implied acceptance of whatever is posted on a board, in a car park.

Ha ha my bank had a sign in their car park saying "if you go so much as a penny overdrawn we will slap a huge charge on you" I disregarded this and chose instead to believe what they put in their glossy TV adverts about listening, so how can I complain now they've robbed me money

scenario that didn't happen why does anyone take any notice of a TROLL?

In my oppinion they just trying to get some more money, and sound more reasonoble. So what if it become like a scam: parked for a 10 minutes, drive away, return after 4 hours. There is plenty of these cases on this forum...
  • How do they know who the "You" is in the term "You agree to pay £80"?

They must use ANPR with very good cameras on the driver, linked to a database of every driver in the UK.

Or just the usual nonsense from the pirates.

If that database exists, then it would only link to the registered keeper and not the driver. They have no way of identifying the driver.
What part of "A whop bop-a-lu a whop bam boo" don't you understand?

The only database they will be linking to is their own and this will consist of records of all of the vehicles entering or leaving their sites successfully captured by their cameras.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

They are that certain that you are too lazy to shop elsewhere that they can try and scam the customers.
