Car Toed off by the police & impounded without any notification

    .... 'private' residents space, then the car tax laws take effect and DVLA or the Police are entitled to take action.

    Actually I think you will find a private residents space is just that, it just not form part of the public highway and in order for the police or DVLA to remove ANY vehicle from there that was not causing a nuisance or danger to the public then they WOULD need permission from the owners of the land otherwise they could quite easily be guilty of tresspass
    No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

    If the bay is owned and maintained by the council then permission is probably allready in place.
    Op has not answered question re insurance.If car was not insured and lets say it was stolen and then invoved in an accident it would not cover losses to a 3 rd party.
    Cars like this parked up untaxed [in bays or not] are a menace.Many fall into disrepair and are targets for thieves and vandals.If you mum is not in a position to meet the costs associated with owning a car then perhaps she should consider selling it.Car ownership is not a right.
    The rules are there for all to adhere to whether you agree or not.
    I am glad cars like this get towed they are usually uninsured ,unroadworthy etc etc.
    Op mentions notice,Has your mum not got a tv ,How much notice do you need.

    So presumably the car was towed because it was untaxed and was not off the public highway as declared on the SORN. If the car is roadworthy and of value, why has your mother submitted a SORN. I've only declared as off the road when FIL died and his tax was due to expire and car was being collected by council for scrap. I had to put the car on my drive to be "off the road" as In-laws residents parking is on the public highway. Also if it wasn't on the address given as "off the road" then she must have driven it to you - again illegal.

    I don't think that the Police have to tell you they have removed your vehicle for being illegally on the road. I know one man turned up at Police station to report his car stolen and they informed him it had actually been towed by the DVLA/Police (they work together and go out looking for vehicles that have SORN's in place or have been reported as being on the highway and untaxed). Made me laugh.

    While agreeing the charge per day is excessive if it was untaxed and on the highway, especially being used, then your mother only has herself to blame.

    i was lucky the other day, my car was on our drive which is classed as a ublic highway(i thought since it was on the drive it wud b out of the way) and my tax ran out on wednesday and i hadnt put the new tax disc on until thursday nite,

    I think you'll find the reason I put private in 'private' was that it was referring to the previous posts where people assume that the space is actually privately owned by them when in fact it is public land to which they have access and a technical right to use, not own. Sorry for any confusion that caused.
