Car Toed off by the police & impounded without any notification

    No outcome so far, mum is in a right state. my house is ex council but ive brought it, the car spaces out the front of our house is not named parking but is for the residents, of which only 4 have cars out of 8 spaces. Im not sure what to do now! i just feel really sorry for my mum what a mess...

    well the car is registered in my mums name in northampton and i live out of northampton so they should have written to her to get her to move it i feel towing it without prior notification is so unfair..not as if it was a jalloppy on bricks its a good car with no disrepair ...i feel that whatever the rights or wrongs of no car tax they have not followed the correct proceedures therefore something should be done to claim against them, but not sure who is at fault the council or the police or both, tut tut tut!

    Legislation dictates that a vehicle should have valid road tax if it is on a public road ie one maintained at public expense. You need to understand that although residents parking areas might be seen as being private by virtue of local bye laws or local legislation they are still maintained at the public expense.

    The road extends to each curtalidge so if you are parked on a grass verge, the pavement etc you need valid tax. If you own a car and store it within the bounds of your land, in a garage, barn etc then it needs a SORN.

    Its really simple you just need to read the documents the DVLA send.

    No tax often runs hand in hand with no insurance and no MOT, vehicles like this should be towed, they are a nuisance and often a magnet for local children to damage etc.

    So what you're saying is that it's ok for you to have no insurance and not to check whether it's ok to store the car where you did, but that because it didn't work out how you thought it should, someone else is to blame and you should be able to claim compensation?

    I'm sorry if it's sounds like I'm attacking you - I'm not - I'm just a little frustrated that you seem to be looking for someone to blame, rather than a way to fix the problem. It seems to have been established that the car was not on private land, therefore you need to sort the situation out quickly, before the charges involved amount to more than the car is worth. Go to the pound and speak to them - ask them the best and quickest way to proceed. Can any other family member help you out? If your Mum isn't very well, is she getting help from the state? Maybe her local council can help. Have you got a neighbour you're good mates with who might be able to help?

    Go for it and good luck - hope you get it sorted quickly.

    Not seen it mentioned but you would not be able to legally move the car without road tax, well at least by driving it anyway.

    Im not looking for anyone to blame! im just frustrated that mum has been now landed with fees of £160 per day for a car that is perfectly decent and a shame that because she is not in a financial position to pay the charges has now lost her car or will do when its crushed.

    Have you spoken to the police again and asked them to clarify the position regarding why it was taken?

    What about the pound? Could they give you any further info?

    When I had my car towed (freaked me out completely!), there was a huge yellow sticker on the windscreen saying exactly why it had been towed. Also the guys in the pound had the paperwork for it - and were actually very nice and helpful.....(not surprising since they took £200 off me for being parked in the wrong bay where someone had moved the sign saying I couldn't park there).....but you should try it....anything is worth a shot at this stage!

    Yes, but at the end of the day the car was untaxed. You see plenty adverts on tv demonstrating what DVLA will do with/to untaxed cars. As has been said, if the car is not on totally private land, even on a roads verge, or 'private' residents space, then the car tax laws take effect and DVLA or the Police are entitled to take action. This can involve towing a car away - without notice.

    I think that expecting some sort of 'special' treatment or dispensation is a bit much after the event.
