hi all,
Am hoping someone will be able to advise me here please
here's the basics
On the weekend I have had a friend staying over. Outside my property and all along the street is resident parking only, but on the opposite side of the road it is one hour allowed and no return within 2 hours. I advised my friend to park here.
However, they have now been booked twice over the course of the weekend but on inspection of the tickets the timings and reasons are incorrect.
The first ticket has no start time just an end time and the second ticket only has a 3 minute window yet your allowed to park for an hour!!
So, my question is this do we have grounds for appeal? How can I prove that they were on the side of the road where 1 hour parking is allowed as when we opened the tickets to look for the reason it says no permit on one and just a code on the other!, yet they were 100% NOT on the permit side of the road!

1st question is whom issued the parking ticket, be it council or some private company?
From the sounds of things (tickets not filled out correctly) it sounds private.0 -
I believe they were both issued by PCSO's because there is a code inside by rank number of CSO ***. So its basically - the police??0

If I want to appeal then I have to fill in part 3 of the ticket and send it to The Manager at a central ticket office address and if I want to pay I have to sent the money to a 'Fixed Penalty Notice' address.
Basically if I appeal it goes to a court hearing??0 -
It sounds like a council or police job to me. Even if it's from PPC, it should have a name. Whoever issued it wants you to send the money to the right place.
Your friend was staying over and you advised them to park in a 1 hour only area? I have no possible comment to make at this time.
The acquisition of wealth is no longer the driving force in my life.

Sounds like a proper police ticket, and if it is a proper police ticket it might be easier to pay it up as the only way to appeal involves the court (where if your not successful the charges increase)0

It is obviously the police from what you say. Usually they are a lot more receptive to well-reasoned argument than councils, as they would have to take it into a magistrates' court to enforce and the CPS wouldn't want to be made to look stupid. Take a load of photos and write politely to the central ticket office with your concerns.
It appears clear the PCSO made the mistake of assuming the whole road was subject to a permit scheme.0 -

yeah I appreciate the coms and to be fair there were times when they had been parked over an hour, I would have had no problem with paying a ticket that was issued correctly i.e. the timings being over an hour etc and would be quite happy to pay up (well not quite lol), but I certainly wouldn't be raising a query over it.
My issue is that they have issued a ticket saying there was no permit on the vehicle when it wasn't needed0 -

thank you, that's basically what I thought, about PCSO error I was just curious as to whether it would be worth appealing or just pay up as I have no way of proving which side of the road they were on0 -
If it helps, my experience of dealing with the police were quite positive. Before my area went over to council enforcement, I got four police tickets. One I paid as it was a fair cop and the traffic warden was very reasonable. Two I queried and they were dropped with one letter. The fourth was more complex; I thought it was wrong, and it went to one hearing after which the CPS dropped it and paid my costs.
The police are still more honorable than councils in my opinion. And it may be that the PCSO will be honest enough to admit an error. Certainly worth questioning!0
