problem with ipone 4 with orange contract

hi

i have had an orange contract for a number of years alomg with my partner.

last january i upgraded my iphone 3gs to an iphone4 i had problems with reception from the start

last february i complained to orange who put me through to apple who told me there were problems with the iphone 4 anttena so they sent me a rubber bumper

still had the same problems but worse keep getting network lost message

called orange again passed me to apple who talked me through a full restore (which lost all my contacts)

still had the same problem

called 2 or 3 times since only to be fobbed off with rubbish passed to piller and post and goig through the saame actions

last week i had enough called them and was told it was my sim card so they would send me a new one

got new sim card same problem

called today engineer went through everything and yold me its a hand set fault but he couldnt do anything about it and its best to call apple

called apple was told im out of warrenty so it would cost me £25 to talk about the fault on the phone with me..... told him to stick it

called orange back after 45 minutes of being passed to everyone in orange i was told i could finish my contract early and pay £250 for the pleasure then take out a new contract ot claim off my personal insurance

do i have a leg to stand on with orange about getting my handset replaced? i pay almost £50 a month for my 2 year contract, only use about 30 mins of my 'free' 600 mins as i cant get a signal

please help

    I also have the iPhone 4. Mine is a 1st generation one (I got it a couple of days after it first went on the shelves). I've had the signal and proximity sensor issues (cheek-dialling I think people called it online) since day one. Apple replaced my phone within the first month of getting it. 2nd phone also had the problems. I received my free phone cover (not just the 'bumper' but one that covers the back and sides). 2nd phone returned to Apple and came back with apparently no fault found.

    After playing about with the phone myself, I have found that if I turn off the 3G (settings>general>network> enable 3G to 'off') I have found I get better signal strength.

    Has this been suggested to you?

    The iPhone 4 antennae 'problem' was been overstated, but the bumper did resolve it. Your difficulty with Orange may well be due to network issues and for this they do not offer reception guarantees. You don;t say if the phone works well in other areas, if it does and the issues are only at home, this would point to Orange havinjg issues in your area (or just naff coverage, as they do in mine). You also have access to T-Mobile base stations so make sure you watch out for it switching and diusplaying T-Mobile as your serving network.

    Your ability to make calls on your contract has nothing to do with your phone - it it stopped working, you still have to pay. As the phone is out of warranty, they are right it what they say - but you may find it better to box it up nd sell it on an auction site, it holds its value well, and others may not suffer the problems you have.

    You have, but it is not simple - assuming that other phones don't have the same problem in the same location.

  • problem is all over my place of work has a phone mast in the car park lol. Orange have confirmed it is a hand set problem but told me there is nothing they can do as its 15 months old. I told them about my problems from day 1 and they said if it was that bad i should of kept complaining with the first 12 mths as there is nothing i can do now. They then said to claim on my insurance for a new handset, but i dont see why i have to pay an excess for something that is not my fault.

    If i turn off 3g it doesnt happen like the person said above but again its an iphone 4 i want 3g working on it


    i quoted the sale of goods act and the lady at orange said good luck lol really crap customer servive

    Because the goods were supplied to you in conjunction with a service, your rights are under Section 11N of the Supply of Goods and Services Act 1982, not the Sale of Goods Act. As the goods are more than six months old, if Orange dispute that the goods had a durability defect at the time of supply (in breach of Section 18(3)(e)), then you will have to obtain an independent report on the cause of the defect. If the report confirms that the goods are not durable, then you can claim the cost of the report from Orange in addition to the cost of the repair under Section 11N. Your rights are against Orange as the supplier of the goods, not against Apple as the manufacturer.
