do you know I hate threads like this one becasue the poster inevitably gets all shirty when told yes they do have to pay the money back.
After all if (as already said) if it transpired that the employer had unpaid the employee would the employee turn around and refuse it - hardly !
Also these type of threads then get all nasty with the person asking the question saying that the rest of us don't understand and how its their ball and they're taking it home.
As for the OP in this case,all I have to say is be careful.......just becuase you won this time round in terms of being reinstated, don't think that your card isn't marked and that by getting all shirty and spouting rubbish at them you wouldn't find yourself made redundant again but this time they will have ensured that all the i's and t's have been dotted and crossed.2014 Target;

There may be a further complicaion.
You have effectively been reinstated as if you had not left
so any payments from the goverment, JSA, esa etc. may need to be reassessed and possibly repaid.
If you had an appeal in against the dismisal then the CAB advice was suspect since the money recieved(even if correct) as PILON would have had to last for the notice period since the benifits like JSA would not be available if reinstated.
Also were you on 3 month notice, statutory would be 12 weeks not 13.0 -

- 4K wont affect your tax credits based on last years earnings. You are allowed to earn 10K this tax year without incurring an overpayment.
- You wont be returning your details soon as the HMRC haven't sent out end of year reviews yet and you have until July to finalise and will have your P60.
- If last years income was higher than current years HMRC can assess you on the lesser income.
- Your pay office made a mistake and overpaid you and you have to pay it back.
- Unlike the credit cards that you paid off this loan won't have interest so your quids in.
- Why dont you ask your trade union what your options are around repaying.

I'm confused. If you didn't look at your account how did you know there was enough extra to pay off your loan/credit card? Where did you think it had materialised from? It won't affect your WTC because (a) it's under £10k and (b) you're going to have to pay it back anyway. To be honest, I'd be gutted too, but I would have questioned it when the extra money appeared in the first place.DMP Mutual Support Thread member 244

Remember the OP knew she'd be getting some money from her company -and as they hadn't sent her a final payslip at that point she would have simply looked at it and thought "More than I thought " especially as she was not mentally 100% at that time her priorities were not to dot every i and cross every t but simply see how much was in her account and deal with outstanding bills.
