It has been nearly 4 weeks since i was granted a debt relief order. One of my creditors a credit card company which was one of the lowest amounts owing to.
I checked my bank account and found i was overdrawn not by much as to be honest i don't use the account now.
Anyway i must have totally forgotten to cancel a direct debit and this creditor has come in and taken a payment!
I don't know why the bank paid it,and its made me overdrawn. So worried because i don't want the insolvency service thinking i have made a payment. As its almost 4 weeks since the dro, don't the creditors only have 30 days to challenge a dro?
Advice please

Remind the company that the account is in a DRO and request the payment back.

Really the direct debit should have been cancelled well before you applied for a DRO. Check that there aren't any others still active.

It's an honest mistake so shouldn't cause any problem (apart from the o/d charge). Hope you're banking with someone unconnected to your debts.

If its a Direct Debit you can request an Indemnity Claim to be done through your bank, the bank will refund the DD then request the money from the company concerned. They have to do this so don't be fobbed off.

I don't know how I didn't see this ''live'' direct debit, plus i'm with Barclay's bank there's no overdraft and why did they pay it? It has made me go £9 o/d. This account has no connection to my debts, I was checking to see if Barclays had closed it, due to the dro.

I've seen 30 days for creditors to object, i get so worried, but objection wise what are their rights and has anyone got ideas of percentages of creditors objecting?

What is there to object to? They might not like the fact that their 'debt' has gone into a DRO but if the DRO Unit are going to take any notice of them, they have to show that you do not meet the criteria - that your debts total over 15k or that your surplus income is over £50 per month or that you have not listed assets worth over £300 (car £1000).

It's not easy for them as they're not told about the majority of the information in the application - just the other creditors and how much owed.

I've never heard about a creditor objecting to any debt in any of my DROs (I'm into 3 figures with them) - that's not to say none of them have but the DRO Unit have not asked me to comment on anything as a result of a creditor objection.

So don't worry and enjoy Easter.
