Mobile Phone Cashback Con
Options
Took advice from this site nine months ago and ordered a mobile on a cashback system. Cost £30 per month. Read the conditions very carefully and complied with the redemption instructions, sending the necessary documents by Recorded Delivery to West Talk Corporate in mid December 2006. Nothing happened until nearly three months later when they wrote to say that they could not "process the claim" because I had not complied with the redemption instructions.
I know I did, but how is one to prove it. I was tempted to take out a small claims court summons, but it would be difficult to prove unless I had independent witnesses as to envelope contents and sealing. So instead, I thought I would warn other unsuspecting (gullible) people out there.

No-one is expected to get their post witnessed.
If you know you did it all by the book then pursue them for your money.
If you can prove you sent them in on time (your recorded delivery receipt will do), and hopefully you have copies of everything you sent them, then go for them.0 -
Thanks for that. Has anyone else had experience of small claims in a case like this?0

It is always worth taking the photocopy of the enclosed claim form as important as recorder delivery confirmation slip:o !0 -

Find out from your Recorded Delivery number when it arrived. Non-compliance is usually either you haven't got the right documentation or that your claim is late.
Now if its late, you need to check when it arrived. If you haven't used a company before, you should always send Special Delivery. Recorded going into the same bag as First Class post which over Xmas can arrive several days late and have the risk of people stealing things.
