Seeing your daughter is an entirely seperate issue from paying for her -your legal responsibility.

You can seek legal advice and persue contact through the courts.

What is it that makes you so worried about the CSA?You keep stating that there will be less paid through them but then say they'll ride you for all you can take!It can't be both!!

Just get on with it because while you two are playing stupid games with each other your daughter is the one who is missing out.YOU can sort the maintenance with the CSA so she still gets her money and YOU can apply for contact.

Which is better?Doing the above or just leaving your daughter without the money for now,to get at her mother, and making matters with the mother worse which, given her stopping of contact, could make her worse and more likely to be peed off with you?

Be the better parent.Sort both, your daughter will be thankful for it and so will you.

    Lord give me strength!!!

Yes I know in the rule book of the CSA my responsibility is to pay for my daughter and that is it. What a system that is eh??? Hence my reluctance to be involved with them in any way shape or form.

I was never married to the PWC so going down the road of the courts is a non starter as I would need an empty pot of money.

My question has been answered on this thread so lets leave it be.
  • Errr the only thing the op needs to do is apply for a contact order £160 I think the application fee is or around that figure . You can represent yourself you don't need a solicitor so please don't bleat on that you need a pot of money you don't my ex took me to court we both represented ourselves , I did pay to see a solicitor for an hour to go over the case and give me advice but it was pretty straight forward in fact it was the best thing that could have happened as we both know where we stand with access.

Sometimes it's easier to make excuses that actually do something your ex can't take you to court as she is the pwc only you can take her . It took my ex 18 months to take me to court and the judge's first question was what took you so long !!!! There are plenty of websites and forums to help you fight your corner fathers for justice etc are apparently supposed to be pretty good BUT just remember once you have a court order that's it there is no oh I can't make this weekend because I can't make it you are committing yourself until the child is 18 . Unless your a monster most dads will get the standard every other weekend .

More doing and less excuses me thinks ........

Thank you for this info, this is info that I didnt know about. I went to a lawyer and I was informed the case would go in my favour but I was also told after the consultation it would start to cost me money. I asked how much it would cost for me to go to court and get an answer etc... etc... and I was told in total around the 5k> mark. I was informed I would get access every week and the PWC would have to stick to it. I was informed if the PWC didnt stick to those rules I would be able to take her back to court but again it would cost me. The PWC would be asked to explain her reasons why she didnt stick to the rules but all she would have to say is my child didnt want to see me on that day. If she continued to break the rules and refuse me access then I can keep on taking her back to court (at my cost) and eventually the judge would fine her or worst case scenario jail her. Its a double sided sword though because do I want to be the person who sent mum to jail or the person who dragged mum to court. I know the PWC will qualify for legal aid so going to court to her will be like a day out at the circus for her.

Anyway thanks for this info, it is something I will look into again as it would seem the lawyer I spoke to didnt give me the full story.

:rotfl: Good boy :p Seriously though, she sounds a pain (stopping contact) so delays would likely have made her worse!

Good luck with court though, let us know if you do go for it :) Every child deserves their daddy and as a mum whose son has just been walked out on I can tell you the effect on the kids ain't nice,so go do what you can because you know it's the right thing to do :)

  • do you need the csa bank details to start payments for your daughter -would recommend that you start payments as soon as possible as not doing so will result in you getting into arrears.

They need to assess first though. Then they'll expect the arrears from the beginning of request for assessment. So put money aside OP for when it's all done (can be 3 months or more)

I think they've already put in place the DMD, so there's an assessment in place of £30 per week (which will be revised once they get the actual information) - any payments made by the poster now would be sent on to the PWC as soon as they clear.
