I almost got run over by a bus this morning crossing the road, but it stopped in time (well I was on a zebra crossing...).
I should get compensation because the bus could have caused me to break my legs.
Sounds stupid doesn't it OP? (replace bus with HSBC and replace break my legs with ruin my credit rating and you have the same situation)
Expecting a 5 figure sum is frankly pathetic. It's been going on 6 months yes, but it's been sorted, it hasn't cost you a 5 figure sum to sort out. Compensation is there to bring you back to where you were before the problems occured, not to give you a life of luxury.0 -

If a debt collection agency was appointed to collect the outstanding amount before you applied for your mortgage (as your post suggests) then you must have known about the default ? DCA's are only appointed as a last resort, how long did this go on for ? Why didn't you sort this out BEFORE making the mortgage application ?
If i'd had letters from a DCA, i would have been applying for a copy of my credit file pretty quickly !0 -
Have you watched The Apprentice too much or even appeared on it, as this is the kind of lunatic behaviour that passes as negotiation these days. You get less than 10K for being the victim of a serious crime, but you want this much because you had a default on your file that in the end didn't actually have any effect on your credit aside from you sorting it out? If you got a couple of hundred pounds in goodwill I'd call it a result.
I'm aware of 'don't ask, don't get', but the art is to make a high bid WITHOUT looking like an idiot who doesn't actually understand the rules of the game (who is ripe for being rolled over with even less than standard goodwill). For laughs I'd recommend you take them to court if you are going to be paying the costs.0 -
to cut a very long story short, basically hsbc put a default on my credit file which they didnt tell me about. Last year I went to purchase a property and couldnt get mortgage due to my credit checks coming back as "failed". Eventually I bought my credit file and it said "hsbc default £216".
This was made an error, I spoke to hsbc and had it removed thanks to a branch manager and went on to buy the house after fighting to get a mortgage for a month. Since then and before that hsbc got debt colection agencies involved to collect the £216 however i told them the story and they backed off and a new dca got involved each time and it went on.
i wrote to hsbc, and a senior manager rang me this morning saying he will rectify everything and said i mentioned compensation in the letter and asked me to provide a breakdown of what i think i should be compensated.
now i need some advice on how much someone has in the past or what amount is suitable?
please bare in mind:
1) the default would have been on their for 6 years from 2010-16 - not allowing me to obtain credit.
2) i was very stressed as this occured around my birthday (Worst birthday ever!)
3) i spent money on copying,posting, printing and calling premium rate numbers as well fuel and parking
4) wasted enedless hours at mortgage brokers only to be turned down
5) nearly got ripped off to a dodgy mortgage company on the net who said they could give me a mortgage (when funnily enough others couldnt)
i dont want to ask too less, as they might think i am a fool and they got off lightly. The senior manager did say they want to sort this out with me (ultimately because i gave him good evidence - he didnt say this ofcourse) and asked me to give them a figure which they can work around - so basing it on that i am thinking to apply the "if you dont ask you dont get" theory. And was thinking 5 figures would be ultimately ideal for the above reasons and many more... (As banks can charge enormous amounts for customerS but why should banks be let off lightly for nearly disabling someone financially).
Any advice kindly appreciated.
(See section in bold)..So are you saying HSBC had actually got debt collection agencies involved BEFORE you applied for the mortgage? So you did know that there was something wrong? You should have really sorted it as soon as you were aware there was an issue.
Having said that, they made a mistake by putting it there in the first place, but it has now been removed and sorted out.
Overall I'd say £150 is acceptable.

I don't understand how the above statement of your fits in with your assertion that you would have remained completely unaware of the debt if you had not happened to coincidentally been buying a property...... ?

The person that bought the bus into the topic, the default was there so your example is pretty useless.
The person that keeps bringing fos into this, I dont know if your in love with fos or you work for them, if you read my OP properly without ranting on about the fos and what they would decide, I clearlly have said the senior manager from hsbc wants to solve matters with me before escalating the matter further. And once again I will tell you that fos does not neccessarily have the final say in the matter even fos says you can go to court should you wish. Are we clear on "fos" now?
In September 2010 hsbc wrote to me saying if I paid 75% of my loan off the remaining 25% would be covered by them. That £216 was the 25% they should have covered. Which they didnt. In oct 10, they got a DCA involved asking for the money I told them the situation. Also the default was put on in Oct 10, you cant put a default on a file and then demand the money!
After I told that DCA everything went quiet since may 2011 - till thent here was no letters from anyone. So why would I need to purchase my credit file? I would not need too!!
It was then when the whole mortgage issue happened. Thats when I got it quickly sorted out. In may 2011 another dca got involved and i paid another visit to hsbc branch manager who got them off my back.
Since may 2011 till the present time I still get them asking me for the money via numerous debt collection agencies, a firm of solicitors who also offered me to pay 50% of the £216 and the other half will be covered by them scheme!!
They have not only wrote to me, but also at another address which I dont own, or ever lived in but its owned by a relative. They have demanded bailiff action at that address.
I have copies of all letters wrote to me as well as receipts/statements showing the 75% of the loan i paid off in 2010 the offer hsbc made to me. I provided these to hsbc when I wrote to them, this is why the manager is adament to solve the issue with me without it being escalated further.
Personally I think some of you need to get your heads out of where the sun doesnt shine! And think clearlly before speaking and especially reading or listening to someone rather than bang on about one little crikey thing (yes, fos).
And for the idiots replying on here (all of your replies are arrogant so called internet "professional advisors" who cant make sense of a simple thing):
There is no reason to check your credit file if a dca is involved, because the job of the dca is to collect money off you that you owe someone else. They will warn you that if you dont pay either bailiff action will be taken or your ability to gain credit in the future will be in jeporady. They did none of this for me as it just bounced from hsbc to dca to me - and bounced they same route back and hsbc got a new dca involved each time!
Bottom line is - october 2010 when dca asked for the money i told them the situation they backed off and did not come back to me. it went quiet for 7 months. anyone would think its all fine as you paid off hsbc and given the dca proof of the deal and payment made to hsbc you wont need to go in to your credit file and be all paranoid!0 -

Op scan the fos letter up when you get the compensation award hahaDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0 -
I dont think any of you had any issue with any company so are talking out of experience.
I had a mobile contract with 3g from 2007-2008. In 2008 when the contract ended I paid it all off.
Again, in may 2011, 3 years later they wrote to me asking for £30 that I owed them from a previous bill. I had no proof as its been 3 long years.
So I went in to the 3g shop in town, got them to pull my account up, and it clearlly said "account paid in full august 2008". Got a print off of the account, got hold of the email address of a senior complaints manager told them the situation and asked for £50 compensation for putting me through distress and costs of parking, fuel, and calling the 0845 number several times to only be put through to india for an arrogant rep to not listen to me.
And yes they gave me the £50.
So before talking crap without experience I suggest you dont talk0 -

I think your either blind or stupid. I have mentioned several times the fos is not involved at this stage. I am talking directly with a senior manager from hsbc.
I think most of you on here earn more sitting on here all day on benefits talking a load of crap
