No problem, I have contacted my bank, I explained I gave my card details to the dealer as a gesture of goodwill but didn't give him any authority to withdraw funds on a cardholder not present basis.

So you lied to the bank. Personally if you'd done that to me you'd find yourself in county court.

    So the next thread.....
"I'm a car dealer and a buyer really wanted a car so I took a deposit on his debit card to secure it. Now he's had his bank cancel the transaction.
    What are my rights?"

On an impulse I thought I would get my wife a little convertible MX5.

I found one on Autotrader rang the dealer and put down a £250 deposit over the phone on my visa debit card. I intended to go see the car at the weekend to buy it ( full price £2500 ).

My wife though that evening decided she didn't like it so I rang the next day to apologise and get my deposit back.

No luck. The dealer said it was a contract and he will keep the money.

Do I have a leg to stand on? It would have been nice if he had warned me that it was non returnable before he took it.

They have agreed to reverse the transaction.

    Result.

what was the purpose of the deposit?

seems well out of order to effectively lie to your bank to get back money you agreed to put down as a deposit!

Wasted the dealers time?....he had the deposit for 15 hrs most of which was overnight. He did no work, the car is still for sale and has no right to my money!

The car was not for sale for the period that the dealer held your deposit, and he was not able to offer that car to any other prospective buyer.
The purpose of a deposit is that it holds that car until you can stump up the balance of the purchase price, not until you can have a word with the missus to decide whether or not you like it:rotfl::rotfl::rotfl:

    In future:

Go to see the car together.
Make a decision to buy it or walk away.

It seems that the OP is not averse to giving people the runaround. I hope that someone catches up with them and teaches them a lesson

You sound like an ****hole if you ask me. I hope the dealer does you over in the small claims court. You RANG him and PAID him a deposit over the phone willingly. Now you've said that you've told the bank you didn't give him permission to charge your card?

You're a liar and a cheat. I don't normally get on with s b but I think if he had a customer like you I'd actually support him.

If you don't want to loose a deposit don't pay it - simple. Then you won't need to come on here and look like a waster.

Oh, and just in case the dealer finds this thread and decides to take you via the small claims process, I'm quoting your opening post below - just in case you delete that to try and cover your sneaky little tracks. DEALER if you're reading, here is the opening post again:

  • Only 2 business sellers have an MX5 listed for that price, as long as the op hasn't lied about the car or price (who knows with there track record on here) the seller will now have a link to this thread:p
