First ever Parking Ticket - advice please

Hi All,

New to the forum but an active reader of the MSE emails! :)

On Saturday I accidentally overstayed by 30 mins in a car park and consequently received a parking ticket from CPS Services (private company not council); I overstayed because a kind fellow driver gave us a ticket which he said had a 'couple of hours' left on it and my wife only gave it a cursory glance before putting it in the windscreen, oh how I wish I'd checked it myself :mad:

If I am reading everyting correctly elsewhere on the forums then the ticket and any forthcoming letters should be ignored and they will go away/cease eventually.

However, mine is a leased company car so I am not the registered owner (the lease company are) and my company are the registered keeper. Does this change anything?

I was considering writing to CPS (using an MSE template) and telling them that their ticket is disproportionate and making an offer of £10 to cover additional parking costs plus some extra for administration.

Any help would be greatly appreciated.

    You can either contact the lease company and inform them that they should ignore this invoice and do not process it as a fine from an authorised body (as it clearly isn't). However if they indicate that they will not play ball then I would advise appealing as you've stated, however do not offer £10, but simply the cost of the overstay 'in full and final settlement'.

    At this point they can either accept this and !!!!!! off, or they will pester you instead of the lease company. And then YOU can ignore them instead.

    You need to stomp on the lease company as a matter of urgency. Tell them that this is not a parking ticket, but an unlawful speculative invoice. If they choose to pay it, that's their decision, and you're not paying them and they are to keep their hands off of your credit/debit card. The administration charge they will also want to raise is a nice little earner for them.

    All you owe the car park owner is the cost of the overstay, and paying this in "full and final settlement" is a good idea. It gives you the moral high ground.
    The acquisition of wealth is no longer the driving force in my life. :)

    To be precise here, are you talking about Combined Solutions (UK) Ltd t/a Combined Parking Solutions ?

    For the benefit of other forum users who might otherwise be unaware but this company has strong links with one Michael Perkins. No longer a director the company is instead run by his illustrious wife, Alexandra.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    They are all or have been suspended from accessing the DVLA database for gross misconduct!

    You must appeal and with current forum advice, you will win at popla - we win 100% of appeals in 2014.

  • Thanks to all who've posted replies, it's much appreciated.

    I've emailed my lease company and told them to ignore any correspondence they might receive with regards to my PCN and not to pay it as it isn't from an "authorised body" (thanks ManxRed and Stephen Leak).

    I'm waiting for them to get back to me to see how they handle this kind of thing, one would hope that lease companies are wise to these companies now! If the lease company aren't willing to 'play ball' then I guess I should write to CPS with either a "disproportionate charge" approach or Coupon-mad's approach (thank you) asking them why "any money is owed". (?)

    Would you like me to update if/when things progress?

    Yes, do.

    The lease company could behave in a number of ways, but essentially some DO realise that these invoices are unenforceable and that - as they are based on a contract to which the lease company cannot possibly be a party - they are not in any way liable themselves. Let's call them the 'good guys'.

    Some leasing companies might just be unaware of how this works and simply need educating.

    However, some leasing companies know exactly how this works, but see a quick opportunity to make a fast buck by virtue of their 'admin charges' - let's call these people the 'bad guys'.

    You just need to find out where yours sits!

    I had a PCN from TPS stating that I left the car park. I had lent my car to somebody who did this (they offered to pay the 'fine' but I declined their kind offer)

    Anyway, when the PARKING ENFORCEMENT NOTICE arrived I wrote to them saying I was not the driver, do not contact me again I am not payingtype thing. (I used the template on here as a guide)

    anyway they have written back 'as a gesture of goodwill'. Saying that they do not accept my appeal and they reserve the right to request the court to order me to say who was driving.However, I was not appealling anything nor did I mention the work appeal. I merely told them I am not paying

    So, shall I ignore or write back to clarify that I was not appealling merely refusing to pay.

    Just wondering, in case they do take me to court.
