Land registry question

Hi,

I have a copy of my deed and plan directly off the land registry website, however it does not contain all the information that I was told at conveyancer's when I went to sign the paperwork, i.e. what fence I am responsible for and the fact I'm not supposed to have a fence around the front, that kind of info etc.

Where do you find this bit? Will I have to go back to my conveyancer and pay?

    Is it a boundary search? The one for £99? I'm sure as you look out the back door I am responsible for the fence to the left. But neighbour thinks I am responsible for "his" fence, to the right. There is no nastiness involved at all, but think it can be cleared up if I can just show him the deed.

    HM Land Registry only transfer the information from the original deeds they require. I have written about this here so many times. One bit of information HMLR tends to "ignore" are the little T or H marks for boundary feature responsibility.

    Bluemanic - "fence on left" is a myth - see the numerous similar messages on GardenLaw.co.uk forums.

    If the original deeds exist then they probably reside with your mortgage lender or your solicitor when purchased. We had to go back three solicitors and two mortgage companies before the deeds were located.

    Thank you. I distinctly remember the solicitor saying I am responsible for the left and back, I made a note of it for future reference. However it depends if you view it as the left as you stand on my back door and look out, or the left as you stand on the back and look down!

    Sorry, I should have said - your fence may be the left however there is no general rule. But this myth is trotted everytime someone asks "which fence is mine" :-)

    Once we found ours it had some wonderful historical information going back to 1900! A lot of which HMLR omitted.

    Hi, yes I understand this myth that the fence "on the left" that gets trotted about. However it is not a myth in my case - I am not a deluded armchair expert who tend to make up and spread these myths lol.

    I am very switched on and specifically made a note of what the conveyancer said. I am responsible for the fence to the back and left - however it depends which "left" you are talking about. If you stand at my back door and look out - or if you stand at the end of the garden and look the other way!

    I always thought and by looking out my back door it was that left. However some comments made by a neighbour has thrown me into questioning my own mind and would like to make sure I am 100% right before I start messing around with the fences.

    If you have the Land Registry entries for your property it may refer to a conveyance or transfer (probably by some builder to the first owner of the property) and it will say "Copy Filed." You need to order a copy of that document. It may well clauses in it about things like fencing responsibilities and keeping the open plan nature of the front garden.

    Thanks Richard - I have emailed the conveyancer who did the original paperwork/sale for me in Jan 2008 and a subsequent transfer of equity in Dec 2009 when me and ex boyfriend split the house. The house was only built in 1979 by the council and sold to the tenant under the right to buy scheme in 1986, then to me in 2008. Really hope she can let me know, even for a charge as I just can't find it on my copy of the deed or plan.

    Hello, I rang the land registery today and they were most helpful. I have now filled in my OC2 and I needed a "copy of transfer" that was dated 22.12.1986. When the original land was sold from the council to the man who bought the house from them. They told me that has the information that I require on it.

    I am annoyed with myself that I have allowed the neighbour to cast doubt in my mind. I did land law as part of law degree, (I did not progreess to become a Solicitor or Barrister, so rely on more educated professionals who practise for reliable and up to date information) so as a consequence/benefit of that and having a bit more of an understanding than your average Joe, and probably just the type of person I am, I paid extra attention to any pitfalls etc that the conveyancer mentioned and I specifically noted I was responsible for the left and back. She even showed me a copy of the "T" on the plan.
    However I believe it is £12 well spent as having always enjoyed a good relationship with my neighbour I would hate to fall out over something as lame as a fence! He is the end house and if I am correct in thinking I am responsible for the left as you stand on the back door it means he will probably cop for all 3 of his fences.
