in Credit cards
Hi there....Looking for some advice if i can please guys.
I used to have a credit card with vanquis which i thought was closed down.
However after searching my credit file..i noticed vanquis defaulted me for £449.
I rang vanquis stating that i had no idea this account was still open..and only found out that i had a default was when checking with the credit refs.
I can not remember receiving a default notice and this was spoken about in the phone call..
The guy put me on hold and said that if i paid £50 there and then and then £200 my next pay day..then the default would be removed and the account fully settled.i said 100 percent would this be the case? and he said yes...ive just spoke to my manager and he has said if i paid 50 then 200.....default will be removed and closed account fully closed.......Which i agreed to and paid £50 right away with him via the phone.......thankiing him and ending the call....excitedly 10 days later..the default was removed from the credit refs which i was over the moon about,
However....
I then receieved a letter thru the door from lowel group debt collection saying i owed the balance......i worriedly checked my credit file...and.....wow....lowel had registerd another default against me for the debt.
I then rang vanquais to ask what was going on....and at first..said the debt was sold 8 days prior to me making the payment of £50.
Long story short.....asked him to listen to the phone call and investigate it....Which someone rang me back a few days later saying yes they listend to the call.....they said something went wrong and they never seen the debt was passed on to lowell.....but would of course honour the agreement..pay £200 to close it down and they will get the debt back from lowel and get them to remove the default.I said that i feel i was lied to by the first agent....and will this really be the case?which i was told....yes....100 percent.....as long as i pay the £200 before 14 days.....
So..paid it that very moment....thinking finally..that is that..
Then today i was worried as it was still defaulted by lowel.....and rang vanquis yet again..and told the lady my case.......and she said she would listen to the calls.
She rang back...saying she listen to the tapes....and that she was very sorry......and that the advisors should not of made the agreement.as the debt was passed on.....and they could not recall the debt from lowel
I said what about the default?and was told they had no control over that...but the account is now marked as been settled with vanquais at there end....and the best she could do was to put a complaint in for me.
I said so is lowel gonna chase me for the debt still and said no.....but saying that in all likely hood the default will remain.
So 2 advisors.......on 2 different occasisons....either lying to me point blank or did something wrong.
Ive asked for the copies of the tapes to be sent to me....which i have been told will arrive within 56 days.
Where on earth do i stand?cause if the default with lowel remains?i am destroyed for 6 years after vanquais assured me on many occasions.......default will be fully gone.
Thanks in advance for your help guys.

I would of thougt vanquis would need to get in touch with Lowell and ask them to remove the default, did you ask for a close account statement off vanquis saying your balance was zero?0

This is why you only EVER deal with debt collectors in WRITING !Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0

i will contact vanquis now and get them to send me a statement saying its paid..settled..and balance is 0.
vanquis just kept saying..they cnt get lowel to remove the default.....as they did sell the debt to lowel...So it would be up to them.
But then contrdict themselves by saying my account is settled..paid and closed with vanquis directly0 -

Except Vanquis aren't a debt collector, they are the original creditor.
I'm sure OP would have dealt with Lowell directly and in writing had they known the account was with them."We can all fly as high as the dreams we dare to live...........unless we are a chicken" ~ Anon.0 -
After reading again vanquis didn't actually do anything wrong but defaulted you as you forgot your account was still open where you were missing payments, surely vanquis must have sent you some sort of letter explaining missed payment.
You might struggle to get a default removed because you forgot about an account.0 -
thanks for your reply Bugsy......But getting the default in the first place is not what is been disputed here with vanquis...
Its the fact..that it was agreed between myself and vanquis to remove the default as it was been disputed...they actually agreed to remove it after hearing my case of not recieving a default notice ....in condition that i pay the 50 and then 200 the following pay day.
After paying the first £50...default was removed as per agreed. With the 200 due next pay.
But then lowel sent me a letter saying they are owed the debt now....and they submitted a new default.
Second call to vanquis...after listening to the call...apologised for the lowel situation..and said..pay the 200 now and it will be recalled from lowel....and the default will be removed...after promising 3 times..100 percent.....it will all go smooth..no problems...long as i pay that now.
Then vanquis said.after a week when i rang them back.....they are very sorry...and agreed that what i was told.......by 2 advisors....and autorised by there 2 supervisors that the default and debt would be recalled and settled was wrong...but they could not recall it.....but mearly mark there records as it been settled and paid......0 -
I am sorry for the problems you are experiencing and I know this is not the point but I cannot understand how someone who has a sub prime lender credit card can conveniently forget about the debt in the first place.0

Exactly. How can you forget you owe over £400 on a card. How can you have thought the account was closed if you have never paid the £449.
I also find this whole story to be a bit odd. How long ago did this default take place?0 -
Wow this thread doesn't make any sense at all.
So? you forgot you owed this or what? I can't make head nor tail of it."We want the finest wines available to humanity, we want them here, and we want them now!"0 -
I don't know.... The op forgot to make a payment of £449, not a small amount and still think the op is not at fault, it's the card company.0
