Yes they can, although whether they're actively looking or not, I don't know.

By what means does a network enable the "Personal Hotspot" (tethering) menu on the iPhone? When I insert my Orange SIM card into my iPhone, I get the spinning circle on "Personal Hotspot", following which the function is disabled. The iPhone seems to be querying something, probably with a remote server, but I may be wrong. Is enabling of Personal Hotspot done by a permissioning on the SIM (e.g. a SIM update), USSD, IP, or some other means?

Yes you can and makes no difference to o2 if your tethering as simplicity includes it.

Apple often releases new software with new features and fixes - you really want to apply those updates and Jailbreaking your phone will mean you wont have immediate access to those improvements...

O2 does offer new iPhone tariffs which activate the "Personal Hotspot" feature which is good but the drawback is that these tariffs have data allowance limits and once you reach them the internet speeds drop badly!

In my experience I found that those allowance limits didn't work for me as I started to use skygo and went to hit the monthly data allowance in no time!...

I requested my pac and moved to "other" networks... on a PAYG basis I went to Giffgaff which is o2 with unlimited data but they had no tethering.... good stuff there but no tethering...

Currently testing Three on a PAYG basis - £15 gets you unlimited data and tethering option activated... In my experience I found the speeds to be very solid and now get data in places where o2 could not deliver (e.g. London Waterloo Station!)

Three operates on a different frequency that o2 so you will need to get used to the signal levels that the iphone displays... rings alarm bells at the begining but at home I get 7mbit speed when the iphone is showing only 1 bar...

Before you go on and Jailbreak, I would suggest you explore other networks on a PAYG basis and see they work for you...

No, it doesn't. Three and O2 both operate their 3G service on 2100MHz. The difference is that O2 additionally has 2G coverage on 900MHz and 1800MHz.

O2 do actually operate their 3G signal on the 900Mhz range as well.

There is an app in the app store called Rock Paper Scissors (made by JGF and costs £1.99) that lets you tether with a hidden feature without the need for personal hotspot being activated by the networks

Not tried it myself but have heard it does work, but can be hard to get it going

They use a separate APN (access point name) for tethering, the iPhone queries whether this APN is present on your account, if it isn't then you can't tether. All the jailbreak does is change which APN the iPhone looks for, instead of looking for the tethering APN it just looks for the normal internet APN and uses that
