PCCN Appeal declined - advice please :(

Hi all,

Would appreciate some advice. :(

Here is what happened:
I parked in an ncp car park, paid the correct amount, 1/3 of the car park had been taken up by the Tuesday market, there was literally 1 space available, which I got my little vw beetle into and went into town. When I returned, with half hour to spare on my ticket, I had a pccn, stating I hadn't parked within bay markings. (on my return, the market had packed up, there were lots of spaces and the cars either side of me, who had parked squiffy had left, making it appear that I had parked with disregard to anyone else) My appeal has been declined and here is the email they sent:


Thank you for your recent appeal regarding the above Parking Contravention Charge Notice (PCCN) issued at our Clacton Jackson Road car park.

I appreciate that it must have been frustrating to return to your vehicle to find that you had been issued with a PCCN. We encourage the responsible, safe and considerate use of our parking facilities by all our visitors, and occasionally we have to enforce these standards by issuing a PCCN which is a necessary part of keeping our car parks functioning properly for customers who use our service.

The Parking Contravention Charge Notice was issued to your vehicle as the parking attendant observed and recorded that the vehicle was not parked wholly within the confines of a marked bay.

Whilst I appreciate that the inconsiderate actions of another driver may have prompted you to park overhanging the bay markings, this does not preclude you from complying with the parking regulations. When parking in a marked parking bay a driver must ensure that the vehicle is positioned so that none of the wheels are outside the bay markings. If there is insufficient space for the vehicle to park within the bay then the driver is advised not to park in that bay.

The lines between each parking space designate where one parking bay ends and the next one begins. I am sure you can appreciate that we have to ensure that people park within the marked lines because not doing so can cause serious inconvenience to others as well as potentially preventing an adjoining bay from being used at all. Therefore, having considered your case fully, I must advise that the PCCN was correctly issued.

This parking contravention charge notice was issued as the vehicle was parked in contravention of the car park terms and conditions. When you enter and park at the site, you agree to abide with the aforementioned, and accept that if you do not abide with them, that you may be issued a parking contravention charge notice. I respectfully draw your attention to the extract of the terms and conditions that are detailed below.


"10. PARKING CONTRAVENTIONS
(a) It is important to the effective management of the Car Park:
(i) that you do not park within a bay designated for a specific purpose when you are not entitled to do so (e.g. parking in a space for the disabled without an appropriate disability badge displayed);
(ii) that you park within a marked bay;
(iii) that, in relation to pay and display sites, you comply with the requirements set out at paragraph 9b and your vehicle does not remain in the Car Park for longer than the duration allocated and paid for; and
(iv) that you comply with all signs in the Car Park.

(b) If you do not comply with these requirements then we may charge you a Parking Contravention Charge. This is because we will incur a loss as your actions will prevent the efficient management of the Car Park. The amount of the Parking Contravention Charge represents a genuine pre-estimate of the additional expense incurred by us as a result of your incorrect parking. "

You must ensure that you park your vehicle wholly within the confines of a marked bay at all times.

I have considered your challenge carefully and, unfortunately, we have declined your appeal to cancel the PCCN. The amount of #50 must now be paid within 14 days from 30 March 2012 in order to conclude this matter.

    Welcome to the fairy tale world of private parking where appeals are never (very few exceptions) accepted and where they make up the rules to suit themselves. As NCP don't normally do court they are safe to ignore.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

    It doesn't matter a hoot what they sent. They ALWAYS turn down appeals. Standard procedure. After all, they have 50 reasons to do so, don't they?

    Luckily, their "fine" is completely unenforceable and NCP NEVER make any actual attempt to enforce it. They are an intelligent company who realise that there is an ample supply of mugs who will take them seriously and pay, so there is no need to resort to iffy and unsuccessful court proceedings.

    At the moment they think you are a "live" one who actually took their fake ticket seriously. So, by turning you down, with perhaps the most BS reply I have EVER seen, they think you will now pay up.

    Disappoint them. Show them you are NOT a mug who gets taken in by this type of scam. Just totally ignore them from now on.

    Look in the stickies for the chain of pathetic and patronising letters you will be sent, so that you will know what to expect, and what will be the final one before they give up and go away, never to return.

    You never owed them one penny, and if you are patient and hold your nerve that will be the outcome.

    Guaranteed.

    Do come back and report how things are going, though. It will benefit others who have fallen victim to these plausible scammers.

    You have not received a "parking ticket" or a fine !
    It is a fake !
    Yes it may look very official, that is because it is a scam ticket designed to impersonate authority and what you have from a legal standing is a INVOICE which they are INVITING you to pay.
    You can IGNORE everything from now on and they can not do a great deal about it, except:
    Send lots of silly letters impersonating more authority and then impersonate even more authority in the characters of fake solicitors, fake debt collectors and fake phone calls from more fake debt collectors.
    Then if you stay IGNORING they will give up.
    The LAW states that a private company can not issue fines or charge penalties outside of what loss you have caused, which as you paid for your parking is ZERO £0.00

    All appeals are rejected as it's a barely legal scam they are pulling, that works on invites rather than demands and replaces words with, may, could, might to just stop short of extortion .
    So calm down, mop your brow you came here, do some more reading, even look at the letters they will send before you get them ! yes the scam is that predictable and follow the advice and ignore them and all the silly letters and beware they change characters as the scam is designed to frighten you in to thinking they have some kind of authority.

    What did you expect? Why would they allow any appeal? What's in it for them?

    All you owe them is what they have lost as a result of your heinous crime. Which is nothing, as you bought a ticket.

    The legal bottom line is that a private company can no more impose a punitive "fine" or "penalty " than you or I. Only the local authority and police can do so.

    So you can either ignore, or counter-attack by sending both the car park owner and the PPC a "Letter Before Action", telling them to stop or you'll sue both of them under Section 3 of the Protection of Harrassment Act. Explain to the car park owner that they are "jointly and severally liable" with their agent, the PPC. Then, when the PPC sends you another letter, sue them both. That should make the car park owner think twice about continuing their contract with the PPC.

    Thanks Stephen, yes, that is the alternative way forward, however I imagine only one LBA will be required since unusually in this business, NCP own most of the car parks themselves...

    I wrote this thread as a nervous, quivering wreck, but now, thanks to your posts guys, I'm feeling rather 'GRRRRR! :mad: I SHALL NOT BE KEPT DOWN BY THE MAAAAAAAN!'

    I'm choosing to ignore them completely and let my dog snack on their follow-up letters :rotfl:
