advice needed urgently

hi all,i posted on here a while back after having problems with my private renting then being served with a section 21,

After now being accepted homeless in priority need and unintentional by my local council,i still have to remain here until im successful on bidding on properties,

my last day ends today i have informed the landlord i can not move as yet,


she wanted me to sign another contract for a month i said no as i know it would void the section 21 and i would be back to square one again,she wants me to put something in writing to say i need to stop on a few weeks again i will not,

they are coming to inspect the property on monday,why i dont know as they left it to me a complete s***hole to me no gas cert failure of electrics which i had to get environmental involved long story.

she is saying if i dont put something in writing she wants the keys back,again i know she needs to take me to court,i really hope it does not come to this,

i feel im going to get a lot of hassle monday can anyone advise me what to tell her,

i will find out next week if ive been successful on 2 properties ive bid on,

the council have been great,showed them evidence through pictures the state of the place,

im now in priorty for housing to get the hell out of here as possible.

i think section 21 was served as i got the environmental which i had every right to after being ingnored time and time again from her,also she wanted alot more rent.any advise would be really appreciated as myself and my family have been through hell the last 8 months.thank you

    Just tell her straight that you are not leaving as advised by the council and that she will need to get a court order to get you out(change the locks if necessary).
    If you can be bothered then explain to her that this has all come about due to her lack of commitment to her side of the contract.

    Speak to the Council on Monday morning, tell them that you are happy to stay but only if they promise to pay the landlord's court application fee and reasonable legal fees. If the landlord takes you to court these fees, usually £200 - £300 are invariably awarded against you by the judge.

    If they agree get this in writing.

    If they don't then ask them to provide you somewhere to stay temporarily until they permanently house you (and remind them that they have to help you store all your possessions) - they won't want to do this - if they don't change their mind ask to speak to a Team Leader or Manager.

    Any Council with just a bit of common sense will accept the liability for £300 than spend lots of staff time and possibly hard cash in finding you temporary accommodation elsewhere.

    Then it won't matter if the landlord has to take you to court!

    Can't better the advice here. Just want to wish you luck, and to ask if you have actually reported this to your council, that is the Tenancy Relations Officer, who might be able to amass evidence and if they are really bad, (I mean really bad) ultimately they might face some sanction.

    Thanks for your replys,i will tell her i know my rights as i think she bascially wants the keys if i dont put something in writing


    Just dont know why she wants this, makes me think shes would use this against me

    I will just refuse,will have no choice if she gives me a hard time to speak to the council

    Ijust dont want this but have no choice but to stay put for now

    Hi. As you probably know the S21 is only a notice that the landlord requires the property back. It does not give the landlord the automatic right to get the property back. As you know (and so should she) she will need to issue court proceedings first and then appoint bailiffs.
    You can always ring Shelter for help and advice.
    Oh and if she does get funny you can always ring the police if neccessary.

    i will update what happens,going to give shelter a ring,i only hope i get out of here pretty quick.thanks for all your advise.

    You don't have to give her any keys. You don't have to let her in to inspect unless she has a court order.

    Tell her that you have had your application accepted by the council but that they have not found you a place yet, and that she should contact them if she wants to speed the process up.

    She is welcome to go to court to repossess the property but you cannot leave

    If she is persistent on getting the keys or otherwise harrassing you, call the police and ask them to attend.

    So i can actually tell her she can not inspect the property,i thought you had to let them in if given 24hours

    she has no right to enter, change the locks if you are concerned (make sure you change them back when you do eventually leave)
