    Very true.

    The one thing i don't understand is that the advice posted on other threads in relation to the private parking fines. People have posted that they have ignored threatening letters/fines from the said company and nothing has ever come of it, including a letter with a court summons/ccj?



    People on the parking forum have posted the truth.

    A private parking 'charge' can be ignored completely and is certainly not a fine. Watchdog covered it AGAIN last night!

    I say you are a PPC plant trying to scare memebers of the forum. Peter Hasbeen I presume? Nothing better to do than troll forums making people think UKCPS can stop people getting a mortgage? In your dreams.

    I can honestly say that i have had a CCJ against my name in relation to an unpaid parking fine from UKCPS, i was refused a mortgage this week.

    Coming on here was a last resort to try and see if anyone could offer any advice with obtaining a mortgage with a CCJ to my name.

    Regardless where/how i have got the CCJ i now have it against my name and im stuck with it for six years.

    I am in no way trying to scare any members of the forum and im not Peter Hasbeen whoever that is?

    Ok i am sitting down with a mortgage broker again on Tuesday so will hopefully have some good news to report back with.

    Ive done a few searches online for a mortgage with CCJ history and to be honest apart from the initial arrangement/booking fees the mortgage payments are not that bad.

    The advise always given is to ignore letters from the private parking companies, but to never ignore any court papers from the court.

    I must admit when I saw your original post I thought you were from a private parking company and were scaremongering but as your post is in mortgage board and not the motoring board I gave you the benefit of doubt.

    How far any business will go in recovering the debt is a matter for them. With the ability to track people these days. Along with the importance of credit reports for individuals to obtain finance of any kind. Then at some point people are faced to pay up or suffer the consequences.

    Should add that a CCJ is never minor. I have rarely granted trade credit to any business with one irrespective of amount.

    Private parking firms have never, afaik, 'won' a court case.

    They have though on several occasions obtained a judgement (CCJ) by default.

    Plenty of default judgements are set aside however, but it is far more difficult if you've paid up, as by having done so you are effectively admitting liability for the amount owed.

    But no, as stated above, bottom line is ignore the letters & phone calls, but never ignore court papers!

    As advised you should never ignore a cc claim form as the issuer will be able to apply for judgement in default after 14-21 day if no reply. They don't need to in reality prove their case as you haven't replied to the cc form. I suspect what was meant was that if you went to court you would have probably won.

    Sounds rather harsh to me. The court is a place where all manner of disputes are settled, not just "won't pay" debt.

    So if someone disputes whether a bill is due, perhaps because they feel that the quality of supply was unacceptable, they should in the final instance let the matter go to court. If they lose and pay up, you are penalising them for exercising a legal right. Unwittingly, you are intimidating businesses into giving in to the threat of court proceedings without having their day in court. Ultimately, this leads to rogue businesses having a business model which includes getting away with outrageous claims because no one will risk their credit to stand up to them.

    Sounds rather harsh to me.

    CCJ's are granted as all other avenues of resolution have been exhausted for the collection of a debt. Where the plantiff hasn't resolved non financial matters the judge will throw the application out of court.

    Being in business isn't a game. Business is a tough environment. Where sharks are in abundance.
