Their terms and conditions make it clear that you still have to pay their fees as a % of the refund even if the debt is just reduced and you don't receive anything.

A true joint loan would always be split between the 2 named parties (even if it's just a formality - in theory to prevent an ex-partner running off with the whole refund)

Most PPI policies only cover the first named borrower, even if the loan is joint. If this is the case then they will pay to insured party.
To the OP, I suggest your husband contacts the bank to see if he will receive the money or not. I assume he must have signed the contract with the CMC, if he didn't then he is not obliged to pay them anything.
If the money gets kept by the bank then I would suggest a complaint to the CMC is in order. By now all decent CMCs ought to be fully aware of how banks deal with redress where the complainant is in debt. It is not considered fair or good practice for them to pursue a complaint knowing that the customer is unlikely to receive any redress offered because they have debts. The few semi-reputable ones out there will usually not touch these cases with a bargepole.0 -
