TheClaimsGuys - Help Needed Please

Hi all, this is my first post I’ve been to embarrassed to write this before....

After hearing millions of TV adverts about reclaiming my PPI and how easy it was I though stuff it, if its that easy I’ll give them a ring, I googled PPI claims and up popped the claimsguys (yes I can see you all shaking your heads).

I had 2 loans and a credit card I wanted them to look into (I called them as they were the first name on Google ) I was sure I had PPI on my Egg loan and Halifax credit card but not on my Lloyds loan.

I'll try and give a timeline -

December 11' - Spoke to ClaimsGuys signed all forms knowing of 30+vat charges (I had no idea I could do this myself I wasn‘t told on the phone, I thought my loan would be complicated as I had it topped up and is now with Moorgate) ClaimsGuys said as I called in before Christmas I should get paid out by late February if successful.

A week later I got a letter from Egg, thanking me for my complaint and saying they will be on contact by 19th March (which isn't late February)

Around the same time I had a letter from Lloyds saying I had no PPI on that loan. Oh well.

February 2012, Halifax credit card statement arrives, with -£378 on the balance, then a day later I got a cheque for the same amount therefore I thought they split it. Half of the cash to me and half paying off my credit card.

The ClaimsGuys charges 30%+vat of the cash I received not the amount off the balance in total (£137). I paid it over the phone.

Early March 2012, Halifax credit card statement arrives with the £378 put back on my balance, so they're not splitting it, who knows Halifax haven't said anything they just sent a cheque and my usual statements.

March 23rd, YES! Egg are paying out..... This is the complicated bit I need advice from someone with more brains that me... there's many of you out there trust me...

Egg say they are paying £9571, however as my loan has just over a year to go they will lower my future payments (totalling £1666). My future payments will change from just over £300 to about £200 per month.

So they're sending me a cheque for £7904 (which I‘m yet to receive).

The ClaimsGuys (who have rang three times asking for payment, and I haven't even got the cheque yet) are charging 30%+vat off the whole £9571.

Claims Guys Fee £3445!!!

I realised in January/February I could of done this myself after looking online and seeing this site…. Yes I feel so stupid, what an idiot, I know, I’ve said this to myself many times recently.

Does anyone think I’ll get away with only paying the 30%+vat on the actually cheque I get back from Egg (£7904)

Basically giving ClaimsGuys £2845 instead of £3445.

I understand I was stupid enough to sign up with them so I have to pay, but it just annoys me after seeing how easy it is for these bandits at the ClaimsGuys to charge so much for writing a couple of letters i could of done myself if i'd looked properly.

Sorry for the length of this post.

Please help if you can.

    They will charge against the full redress amount. Even if you do not personally get all the money directly.

    No. That isnt what you agreed with them and claims companies tend to be quite thorough in making sure they are paid the correct amount.

    Absolutely agree. The Claims Guys have twice cold called me and despite me telling them I was an IFA and did my own insurances they said I could still complain. They were complete farce on the phone. I can see why people get fooled though.

  • I thought that'd be the case, i might make them wait for it though, i dont like the constant phone calls when Egg haven't even even payed me yet.

    Just ashame you never checked out the situation before signing up with this lot as you could have done all the work yourself. At least though they have done the work now and that was the agreement to pay 30% + VAT.

    Please make sure that they provide you with a proper VAT invoice if they are charging VAT. You can i believe check out their VAT number with the VAT office to ensure that it correct.

  • Milly, thanks for your reply. I've got the invoice but it says at the bottom 'this is not a VAT invoice'.

    Though it shows VAT at £574.27, when they next call, which will probably be soon should i ask them to send me one first?

    So i'm really not clued up on what this sort of stuff means

    On the request for payment they have sent me it reads...

    Egg has advised that they will being sending the funds directly to you. This means your about to recieve your money back!

    However, you must complete the following to avoid any delay in your money being transferred over to you.


    On the next page they want my card details.... Aren't they contradicting themselves, why will it effect it if Egg are sending me the money.

    It wont. It is the sort of language that claims companies can get away with until they are properly regulated.

  • I was called by Claim Guys and hadn't had any luck myself with RBS so told them I had had a loan & thought had claim . Explained loan in joint names with husband who had credit card debts with RBS and did not want to claim on his behalf . They said its worth putting his name on form as wAs joint. RBS come back purely to husband not me saying £2600 due but Claim Guys hassling me for their £900 but not even sure husband will receive money if he has debts with them. They agree I told them about debts on initial phone call but still hassling me

    Their terms and conditions make it clear that you still have to pay their fees as a % of the refund even if the debt is just reduced and you don't receive anything.

    (see 2. TCG Fees part b on link below)

    A true joint loan would always be split between the 2 named parties (even if it's just a formality - in theory to prevent an ex-partner running off with the whole refund)
