    I guess this is where I fit in then!

    SO much research - thank you to this board and to CCCS - and I'm finally in the process of Bankruptcy.

    My date is set for Wednesday 18th April. The court staff seemed nice and reassuring on the phone, so hopefully it will all be straightforward.

    Just completed my forms and have saved up my £700 (ridiculous, right?), so all set to go. Just need to do one or two more tax calculations for my I&E on the bankruptcy forms. I'm self employed, so it's not too straightforward.

    The court said I should allow around 3 hours, most of which will be waiting for the Judge. Then, I'll get called into his office, and that will be that.

    How long before the OR will call me? Will I need all my paperwork during that conversation, or will the initial call be to arrange a proper one?

    I've got to say, I'm super nervous, a little worried, and I guess I feel a financial failure. Still, this is an opportunity to wipe the slate clean, get on top of finances and get a second (much needed) chance.

    Woody, let us know how it went with the OR. I'm nervous about my house (neg equity of about 8k) and my car (need it for work, worth £1300). I guess, in theory, they can take both, but we'll see!

    Hi and welcome to the forum. Good luck for Wednesday although you will not need it:)
    Usually the first contact with the OR is just to go over some details, sometimes they will make an appointment with you at this time, but they may also do so at a later date.

  • Hello to everyone, I've been a lurker for months if not years so feel I know a lot of you really well.
    I've started the ball rolling today, I should have done this a long time ago when the problem first arose but decided to do a fab impersonation of an ostrich!
    I got caught by a bailiff in the garden who had climbed over a locked gate, my normally mad barking dog just sniffed and wagged her tail! I pretended to be the cleaner so got away with it that time but he has been back and put papers in letter box.
    No doubt I will be bombarding you all with questions but for now I need a stiff drink as my head is pounding.

    In my case, I didn't have to wait to see the judge - I handed in the paperwork, corrected a few items with the clerk and was told to expect a phone call (which I received about 3 hours later "Congratulations you are now bankrupt"!:)) but I think different courts do things slightly differently.

    Usually the OR will call fairly quickly (within a day or two) to arrange the full interview if they need additional information about your case and will give you time to get the information together - don't worry it's not an inquisition, they're only after more details behind the facts - mine was very friendly and we even managed to laugh at the absurdity of some parts of the process!!

    I think we all have feelings of guilt and/or failure, but now I think well I gave xxx a go and I was honest, it just didn't work out the way I had planned so don't beat yourself up too much over it! Besides, the amount of hassle I had from one particular DCA the relief of being able to tell them to go away outweighed any negative thoughts

    I'm not 100% sure about the house, but as it's in negative equity, the OR won't have an interest in it so as long as you can pay the mortgage you should be able to keep it.

    The car sounds borderline (they usually allow up to £1000 for cars), but you may be able to argue that the cost of selling it and buying a slightly cheaper car is not in either yours or the OR's interest.
