Hi Everyone,
I am looking for advice on a letter I received from CP Plus Ltd yesterday in regards to me parking in some services for more than two hours.
The letter states that they sent an earlier letter stating that I received an earlier letter allowing me to apply for a reduced charge or to challenge it. Which I actually did not receive.
Now they are demanding I pay £90.00 within 14 days or an additional administration charge will be incurred.
Personall I don't think I should pay it. I was at a meeting in Costa Coffee there and was not aware of the 2 hour limit.
What are peoples experiences with these people and how do you think I should tackle it?

Our experience (and knowldege of civil law) tells us that you should ignore this letter, and ignore any further demands from them. It is effectively a scam.
Civil law means that these car parks are administered under contract law. This means that they publish terms and conditions at the site and form a contract with the viewer of the signs. Clearly the signs need to be prominently displayed, and thge contract can only be formed with the driver, not the registered keeper (which is who they are writing to). Sometimes this is the same person, sometimes it isn't. They have no way of knowing this, obviously. You are under no obligation to tell them who was driving.
However the killer aspect of this is that under civil contract law, the only redress for a breach of the contract is the actual financial losses incurred as a result of the breach, which in a free car park is zero. £90 do not represent their losses, and if it went to court, you could easily demonstrate that this was effectively a penalty charge levied in order to dissuade people from breaching the terms and conditions. This is completely unenforceable under contract law.
They know this, so they will NOT take you to court, regardless of everything they will say in their letters. They would lose.
They will stick to trying to scare you into paying by sending scary letters instead. DO NOT CONTACT THEM. Ignore all the letters.Je Suis Cecil.0 -
Yup - Ignore them from the outset. Contacting them only appears that you are taking them seriously and prolongs their attampts to get money out of you.
If you check the letter chain sticky at the top of this forum, you will find the entire paperchase in there, so you can tick them off one at a time till they give-up.0 -
Yes, Jimmy. It is a well-known scam that tries to catch the unwary. All you have to do to defeat it is NOTHING.
In other words, ignore the rubbish they send you.
As pogofish says, any sort of reply, or worse, appeal, sends them the message that they have hooked a sucker who believes their fake ticket is legit.0 -
Someone will have to explain this further/provide the background information for me;
I read somewhere on here or maybe Pepipoo that they actually have shot themselves in the foot once they increase the charges after the ticket (£40/80 or whatever it is depending on the PPC) as even if you give the ticket any credit for covering losses/damage (which is what the ticket is supposedly issued for) they have no power or grounds to pile on additional 'charges' (administration etc.) other than the fact that sadly a lot of people fall for it and pay up.
I know that I've not explained that particularly well so yeah if someone can put it in the form I originally read it in that would be great.
Overall Jimmy just ignore this crap - I'm told by the members here that I'm near the end of the letter chain with my case and although I hold my hands up and say that I can't give you a 100% answer until I'm satisfied the PPC have !!!!!!ed off in my case, I would say that the advice on here is second to none, and there are many members that have ignored PPC's and nothing has happened (infact I have not seen anyone on here that has been beaten by a PPC, other than fake posters (who work for PPC's) claiming they've been forced to pay up by courts).
I certainly understand it's frightening, these idiots go well out of their way to intimidate and bully people and it does make me sick. It's not easy for everyone to ignore these harrassing letters and you should do whatever you feel is right for you. However my advice is to not let the parking companies bully and intimidate you, which is their trade, as they have NO right to.
I suggest going on youtube and searching 'Watchdog PPC', that certainly took a lot of sting out of this crap that they send out.0 -

The charges are designed to represent their actual losses/costs. So how come these losses amount to £60 on days 1-14, and then £100 (or whatever) on day 15? Clearly that is nonsense. This is one of the best arguments to use to demonstrate that the charge has nothing to do with their losses and is a penalty. It clearly mimics the charge on a council ticket (£X, discounted to £Y if paid within 14 days, and that IS an actual penalty).Je Suis Cecil.0 -
You will recieve 3 Begging letters off cp give us your money plus, 3 begging letters off Debt Recovery please give us your money Plus then thats the end of there filthy scam SO IGNORE :money:PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:0

Yes that's pretty much what I was trying to get at - that there is no valid reason (bar penalty) for the increasing charges. Obviously based on giving some sort of legal credit to the initial 'fine/charge' (so obviously as losses never amount to anything/are difficult to prove, the argument against the increased charges is kind of moot, but another string to the bow).

A scam that impersonates Authority and the services get a generous cut of the scam money, so boycott them in future !
Beware of changes in character from the impersonation from fake parking authority, to fake solicitors to fake debt collectors, in fact expect anything including snow white and the seven dwarfs.
Do not respond in anyway, it is a scam of empty threats as the amount you actually owe them in law is £0.00
The proven way to beat them is to treat it no differently to any silly letter you get in the post such as ones telling you you have won the Canadian lottery, they are no different, they all have the same aim, to scam your money and like all scammers, if you do pay they will come back for more and more until you do ignore them.

Ive had the same, now on second demand. However they have also sent photgraphic evidence. I cant tell who the driver is but they could blow it to see. does that change any of the advice given here?0
