Thanks all for the replies/support.

Since I still had no response earlier this evening I sent a revised version of my original mail.Received item last Wednesday 23/03.
I am somewhat puzzled in that I did not receive the item as titled, namely: XBOX LIVE STARTER KIT.
This would normally include headset, demo games, 12 Months subscription, etc.
Yes the description said 12 MONTH XBOX LIVE CARD
unused
However that to me meant that the card was not registered. Taking into account the price for postage (£3.00) that would indicate a complete kit size package, not a lightweight card. You might not have designed your listing to deliberately mislead, but that was the end result.
I am sure you can look at it from my perspective and understand how I feel right now.
Perhaps we can arrive at a mutual agreement regarding this matter, please reply to this email.
Regards
Got this in reply:hi please read the auction it states no headsett cheers
Obviously had it been stated in this way I would not have bid.
How do you guys think I should proceed?0 -
Having seen the listing and the minimal information it contained, I would not have expected that the listing was for anything more than a live card, unless the seller was very bad at listing his goods.
Yes the seller was very wrong to say "kit" in the title, but the listing itself gave no indication that anything other than a card was included.
You will also find on ebay that there is no relationship between the P&P figure and the cost to send an item.
20:20 hindsight, but ask before bidding, and if unsure of an item, just walk away.0 -
It's a tough one.

As previously stated, whilst the title is misleading......
"XBOX LIVE STARTER KIT" (implying the full kit)
The description of goods was clear ....
"12 Months X-BOX Live Card New and Unused" (implying the card only)
It's a poor listing and one I would not expect anyone to bid on with any degree of confidence that they were getting anything more than the card only.

Thanks for the replies, looks like I shall have to chalk this one up to experience.0

vultura, i wouldn't let it rest. If you feel you've been left out of pocket (even taking into account sending the item back) I suggest you do a chargeback if you paid via paypal or request a refund. You might also want to send him an email asking on which line "it states no headsett" because, unless I'm missing something, there are only 2 lines, neither of which says that!0

Thanks stavros, I did think of sending him a reply, but at the time I was so fired up... so I left it. You are correct, nowhere in that listing does it mention not having the headset, etc. I have been nice in my messages to him, thought we could reach a mutual agreement and move on.
I did look at paypal last night, but the page I look at said they would only deal with items that weren't delivered, maybe I wasn't looking in the right place.0
