Hi

Someone has taken out Payday Loans in my name. What do I need to do to clear my name..

I have contact them by hone and they are VERY rude. The Police are saying to contact them then they will contact the Police and start the investigation.

Does anyone have any Template Letters I could send them today?

I will not pay them a single penny !! But they are claiming to default my credit file and take me to court??????????/

Has anyone actually been taken to court or had credit file marked by a payday comany?

Yes there are countless posts on here of people having defaults on their credit files as a result of not repaying their payday loans.

There are a few instances of people being taken to court by payday loan companies and having CCJs issued against them.

Have you formally written to them to dispute that these loans are anything to do with you?
They will know which bank account the money was paid into - and should be able to track down the person who owns that account.
They'll also have details of the person's email account that was used and obviously will be able to check whether all the information entered on the application is the same as yours or whether anything is incorrect (eg such as a date of birth being wrong).

If you haven't formally written to dispute it then you should do so now and send recorded delivery.

Do you have any idea as to who this could be that is knows and is using your personal information?

Have you got copies of your credit files from all 3 agencies to see what accounts are on there that you do not recognise and to see what application searches have been done? you could also check if there are any incorrect linked addresses that someone has linked to your file.

If you think this may happen again you could consider registering for CIFAS protective registration which costs £14 a year but stops others being able to take out credit in your name.

How did you find out about these loans? how did the payday loan company contact you? by email? by post? by phone?

So you have contacted the police and they say contact the pdl? Write to the pdt companies fraud department. Tell them to contact the police or shut up. Ask them what evidence they have that you took out the loan and you dispute it. Keep it short and simple .

So the money was paid into a bank account in your name? What date was that? If its an account you do not use anymore then presumably the loan money is still sitting in your bank account?
When they came to try to take money out of that account - a month later or whatever did they take back as much as they could - presumably the amount of the loan to you but were unable to collect the remainder of the loan i.e the charges that were added?

Or are you saying that someone has managed to withdraw the money from your old bank account between the payday loan company depositing the loan and them trying to collect the funds?

Have you a statement for the bank account so you can see what happened? If money was taken out of the account by what method was this done?

This has all happened to you before hasn't it?
This must be someone known to you who knows your personal details and has access to your bank accounts.

Have you closed ALL your old bank accounts (it was 8 looking at your past posts) to ensure this won't keep happening?

I doubt very much there are any templates for the events that have happened to you - whilst its not unheard of to see posts about payday loan fraud on here, fraudsters generally use their own bank account for the loan advance.

Is the mini credit address not on the letters you have received for the last 3days?

If someone has also accessed your bank account and managed to withdraw money from it then have you informed the bank that it was a fraudulent transaction?
to see if you can somehow recover the money that way, which can then go back to the payday loan company.

    Hi
My guess is that it's either someone you know well, or I am sorry to say you and trying to cover it up.If it is not you, you must go to the police and the bank concerned. Frankly if you do not people will think you have something to hide.
