town and country are a bunch of chancers, dont waste your time appealing, all you do is confirm you got a ticket, end the day you do not need to show your blue badge on private car parks, i have a similar situation to you, currently receiving the scam mail, if and its a big if they take me to court then they will lose, i can prove im disabled, just because they could not see my badge they claim, the fact i have disabled tax should have given a clue to the pond life issuing the `ticket` , i dont know for sure but i imagine dvla which gave them my details should show the vehicle is registered as disabled as well, dont know, dont care, all they are getting from me is further costs from trying to unlawfully make gains from me, if enough people refused to pay we would soon bankrupt this shower of !!!!!! turpins0

It surprises me that they would be using a private company and letting them issue itckets with no legal status, although it is dimly possible. However, in that case, disabled spaces would need to be covered by an off-street parking order and legally issued by council or council contract patrollers. Again, not what you describe.
However, councils have been selling or leasing-off their retail parks at a great rate recently, so it is maybe more likely that it was formerly council owned.
Anyway, what you describe is not a legit ticket, so the chances of it being a legit disabled bay are next to nil!0 -

Great - I know these jokers well and have caught them out for claiming legal authority to enforce disabled spaces under Scotland's DPPPA before - they most certainly had not done the needful to become compliant, so the chances of them being legit in your situation are very very slim indeed.
Ignore them or take it up with the store/park operator is the way to go now.0 -

God forbid, but if a mugger held a knife to your throat, how much notice do you think they'd take of any "appeal"? Actually, no, that's a bad example. You'd probably have a better chance with the mugger.
Why would they allow your appeal? What's in it for them? You've just set yourself up as a target. In fact, you might inadvertently give them information that they could use against you and would otherwise have to pay the DVLA for, but that's another part of this national scandal.
From a strictly legal standpoint, as you haven't done anything wrong, you have nothing to appeal against.The acquisition of wealth is no longer the driving force in my life.0 -
Hi Guys and thank you all for your advice, I have to say that although I hear what your all saying in that these fines from the likes of Town and Country Parking and others are a total scam, and even though its great comfort to me to have you all out there helping me, it does not help the older person like myself stop worrying, in fact I did not sleep much at all last night thinking about it.
Whats annoying is that I did nothing wrong, my badge was in date but the badge had slipped down in its polypocket so that it was difficult to see without cranking your neck.
In addition to all your Helpful advice I am approaching a local police man who we know well to see what his views are, will let over the next few days what he says after we catch up with him.
I am however prepared to go the distance and even go to court if thats what it takes to prove my innocence, so look out Town and Country Parking as you now have a fight on your hands, I await contact from "give them FA" on how to turn the tables on them.
Many thanks again for all your support and advice, its very much appreciated and I will not forget it.

This is not a a fine or any sort of right or wrong, never mind a criminal matter.
You really are giving them far too much creedence and I hope your police friend will disabuse you of that of thinking soon.0 -

Dave, its not a fine, they don't have the authority to fine anyone. They are 'asking' you to pay a charge which they have made up, and does not have any legal backing enabling them to enforce it.
They know this, so court would not be an option for them (unless they are clinically insane). They will stick with the scary letters, because that's the only realistic option they've got.
I realise it can seem scary if you are not familiar with civil law, but that's precisely why these companies exist, so that the people who do not manage to find it to this forum (and my lawyer would like me to point out that other similar forums are available) and simply pay up, blissfully unaware that legally they owe these people nothing whatsoever.Je Suis Cecil.0
