Fighting Back, court cases and so on...

Ive been reading this forum with some bemusement of late, there seems to be one train of thought where you can actualy sue the car park operatives if you have alegedly breached their conditions, and then start getting "harrassed" by various debt collection/balif companies, then theres the other side of the argument from a poster going by the name of pperterson who claims that this is rubbish, and that people who dont pay may go to court, and end up having to pay a substantial sum.

without trying to get into an argument, is their any real evidence to prove the argumenteither one way or the other souch as the outcome of court cases/wins/losses and so on published online, from actual car parking/clamping cases?

    What you need to understand right away, Richard, is that the poster calling himself PPeterson is actually a troll working for the parking industry and is doing his utmost to undermine this forum. I think that may be obvious when you look at his posts from that standpoint.

    Pretty much everything he writes is just rather pathetic propaganda.

    To date the only case I have seen that is touted by a ppc is the old Stephen Thomas case fr0m 2008(I think) This chap boasted that he was the driver on a forum and basically lied to the judge, guess the outcome.
    Logic dictates that had there been many others recently then they would be used.
    At one time a troll listed lots of cases they said they had won until it was realised they had used footballers names and the area they came from.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

    Yes, it was really funny, it seems that PPC exclusively sued Premiership footballers.. there really is no lie to which they won't sink. If you proceed on the basis that everything they say is untrue then you will not go far wrong- you need to view their latest troll, "PPeterson" in that light.

    A few years ago i received a fake joke parking ticket, not a PPC ticket, but a real fake ticket as you would buy from a joke shop, as did a few other cars that were parked nearby.

    not long after, I received another ticket, this time from a car park, again i took it to be a jokeshop fake ticket, and treted it as such, a few days later i received some letters - that I thought were part of the joke, as the English contained within wasnt much better than my typing - the mystery was trying to find who i thought was the practical joker, after a while the letters stopped coming.

    Fast forward a few years and i discovered this forum, and later on this sub forum, maybe some of the letters werent so fake, although in hindsight they werent far off from cheap joke shop quality.

    anyways, after reading through a few posts within this sub forum, one of the things im interested in seeing is any hard evidence that the official private parking companies have successfuly taken someone to court, and won, or an individual has taken an official parking company to court, and won a settlement for harrasment.

    I've seen those practical joke parking tickets too. I wondered about sticking a few onto my car's windscreen, and then seeing whether a PPC attendant would add one, which I would obviously also ignore, or whether he'd think that he'd already ticketted me.

    If I ever do get one, I'll go for the jugular.

    Well, Richard, you have had first hand experience that if you treat the "ticket" as a joke, they WILL go away!

    Unfortunately, I do not think you will ever see any trustworthy information on the subject. The only certainty is that it is extremely rare for any PPC to take anyone to court- some never do; and others say they do, but actually are lying, as the "footballers" episode shows. I stick to my assessment that you have a better chance of winning the lottery jackpot than of being taken to court. And there is also the suggestion that a few of the cases were "set-ups" where they sued someone who let themselves be sued and deliberately lost so the PPC could try and frighten people.

    The "Stephen Thomas" case mentioned above was almost certainly that.

    As for people suing for harassment, they are very frightened of that; if it caught on their whole applecart could collapse. Hence the hysterical pooh-poohing by "PPeterson". More people should do it as they leave themselves wide open with their collection tactics. Unfortunately most people are still reluntant to try, though I know of some cases that may be developing.

    I did just that and collected a tidy sum. PPeterson says he doesn't believe it, but then a troll would say that, wouldn't he? So to clear up the issue I will be making court documents available to a senior member here for verification. I know the PPC troll will not be satisfied by that, but, does anyone really give a toss what he thinks? I believe everyone else here will accept it.

    What's the betting he says they're a forgery? I defer to his expertise in such matters.

    How can I put this kindly. If "he, who must not be named" told me that today was Tuesday 27 March 2012, I'd buy a calendar.

    It doesn't really matter what he says or thinks, Stephen. It is the same old PPC lying game. What is important will be what everyone other than him thinks. Not that anyone else has asked me for evidence, but I think it is important to make it clear that he is just putting up propaganda.

    Consider this.

    Ppeterson runs a PPC and makes money out of this. The more people that pay up, the more money he makes.

    People who post advice on here make no money from it whatsoever. They do it in their spare time, for free, to help others.

    Now ask yourself what the motivation is from each side of the argument, and consider why people on here post what they do.
