Be more vigilant before you purchase.

It won't kill you but take it back and ask for a refund and have a moan and they might give you a voucher .

Why? The emotional distress of noticing that the meal was a day out of date?

I'm pretty sure that this is taken quite seriously as there are fines imposed for having out-of-date items on shop shelves. Depends on whether it's "Use by" or "Best before" though

So legally, you might be on to something. Morally? No harm was done, personally I'd be happy with an exchange and the store to cover my petrol costs to return the item.

first of all - if its where you shop regularly just leave the ready meal chilled in fridge till your next scheduled visit and then take it with receipt - point out that they had overlooked an item going out of date and left it on sale after its use before date, then add that you had not checked the date and unfortunately bought something past its use by date. I am sure you will not need to ask for a refund - it will be offered immediately. Maybe in the time between now and returning it maybe a little reflection on the fact that someone slipped up at Tesco in shelf checking and you slipped up while shopping and didn't check the use by date on the items purchased. Inconvenience, late night hunger - worthy of compensation ? In the grand scale of things I think there is only one person capable of advising you on that - and that is yourself. Of course you could also consider offering payment to Tesco for a lesson learned - after all adult education is no longer free.

Did you actually eat it? If not you cant legally claim for what "could" have happened, only what actually did and even then you're not necessarily on strong footing. However, there is no harm in asking for a goodwill gesture, especially since you're having to return to their store to get it replaced/refunded.

If you did eat it, have you been ill?

no for inconvenience of having to go back - petrol
    carparking charge
    time, effort etc

they really should be more vigilant cos it could make some people ill

should have been picked up on thurs or fri at least by sat eve

I would go back to the store and ask for a refund and remind them it was fortuante that you spotted it not Trading Standards. Normally, if I spot something out of date and there is someone around they are very grateful for it being picked up.

Assuming it was a "use by" date, that is potentially dangerous advice.

I do the same :D Was buying some yoghurt the other week....most were OOD by 30/04.....but these ones were 16/03 and it was the 20th!

Just handed them to a employee and said to check as their might be more. But then I've gotten myself into the habit of checking dates. No point buying something you're not planning to eat till next week when it goes out of date within 2 days :rotfl:
