    I believe that's crap. If you pm me your email address, I'll send you the Ofcom document.

    There are very strict conditions for refusing a PAC code.

    I have sent you a PM - cheers.

    Since posting I have read the trems & conditions on Virgin Mobile website & cannot see anything about PAC codes at all. I have e mailed them to ask them to direct me to the relevant part in their terms or send me my PAC code by return. I'll post an update when i hear back.

    This is the reply I received from Virgin...

    Thanks for your email to Virgin Mobile about your request for your PAC code.

    Under most circumstances we would certainly give you your PAC code within 2 days of your request. At the moment the number that you want to take to another network is under contract to Virgin Mobile. As soon as this contract expires we'll be able to issue the PAC code you require.

    To get your PAC code, all you need to do is give our team a call on 789 from your Virgin Mobile phone, or on 0845 6000 789 from a fixed line. Alternatively, visit our website at virgin.com/mobile and log in to Your Account. When you're there, go to ‘Contact us' and request your PAC code by email. We'll also be happy to answer any other questions you may have about transferring your number.

    There's a few things you might like to do before you leave us:

    - Scribble down all your phone numbers, listen to all your voicemails and have a last glimpse at your text messages. They'll all disappear too!

    - Make sure you don't have your phone abroad on the transfer date - you can only transfer your number if you're in the UK.

    - When you switch network, it's also a good idea to check the coverage for the area you'll be using your phone in.

    - If you're set up to receive Virgin Mobile Bites, remember to cancel these. It's easy to do, just text ‘Stop all' to 22522 – the text won't cost you a penny.

    We have no intention of withholding your PAC code from you and if you contact us when the number is no longer under contract we'll be happy to help.

    If there's anything else we can help you with, just reply to this email. You can also give us a call on 789 from your Virgin Mobile phone – it's just 10p, no matter how long you talk for. Or, you can call us on 0845 6000 789 from a fixed line phone. These calls are charged at local rate.

    My sisters bill comes in each month at £X. This is made up from £Y in contract charge and £Z in calls & texts. If £Z > £10 then assuming that she makes no more than £10 in calls (which she doesn't) then it's cheaper to get a £10 O2 SIM card.

It won't ever be even a penny cheaper.

    And thats even in your very worst case scenario - and I do not know of a single contract that does not have any included texts anymore. Even then, she could still keep the contract simcard to put in and make use of the call allowance, so it would STILL be cheaper.

    Just to update...
    after receiving the reply in post 13 above. I e mailed Virgin again requesting that they refer me to the relevant point in their terms & conditions that states they will withold the PAC code whilst the phone is still under contract otherwise I would raise a formal complaint with Ofcom.

    I got the following reply......

    Thanks for your email to Virgin Mobile in regards to you PAC.

    By reading your email it is clear that this matter has been a far more testing experience than it should have been, and for this we would like to apologise.

    We have passed your details onto the porting team who will forward your PAC via text and also post.

    We'd like to take this opportunity to apologise once more for the inconvenience that this matter has caused you.


    My PAC arrived 24 hours later!

    I called T Mobile today for a PAC and was told it would cost £13.99 if I wanted it now or free if I waited until 30/3/07 (when my contract expires). I said I'd wait!

    No they are NOT wrong!! I did not say it would be cheaper for her to cancel her contract than to not cancel it. I did not mention the word cancel. I said to pay the outstanding 2 months. I did not specify if that was immediately or over the 2 remaining months. You are correct that they would be exactly but that does not make me incorrect as I didn't even say that it wouldn't.

    I said "It'll be cheaper for her to pay the outstanding 2 months contact AND the O2 top up cards because her current bill is higher than the cost of the contract and the top ups"

    My examples clearly demonstrated using a PAYG SIM now instead of waiting for 2 months and then changing.

    Just because you don't know of a single contract you can get now doesn't mean that there wasn't one 10 months ago. Also, perhaps the contract is years old an her most recent phone upgrade was 10 months ago. This would have meant increasing her contract for an additional 12 months.

    The £40 must be paid regardless. The amount spent on calls and text WILL be cheaper with the 02 PAYG SIM (£10 of calling credit and 300 free texts) as she'll get everything she needs for £10. Her contract bill included MORE than £10 of Texts and Calls.

    You've clearly got yourself muddled up after a number of assumptions.
