New quotes whilst an unsettled claim is open

Hi,
I was driven into by a drunk and drugged driver who has subsequently been charged.
I have made my claim and the insurers are processing the claim but it hasn't completed yet. I am due for renewal so I've been shopping around and the insurers are telling me that the unsettled claim must go down as an at fault claim. This has raised my premium by nearly £150! Surely this can't be right. Why are the insurers taking this stance??

It is right until such time that the fault is accepted by the other party.Why are the insurers taking this stance??
Because fault has yet to be accepted. Once fault is accepted your no claims bonus will be reinstated and you can change it to a non-fault complaint. It doesn't work like this.
You don't get your NCD back at the point when the other side "accepts fault".
Only when the claim is closed, AND your insurer has reimbursed in full is the claim considered "non fault" and your NCD reinstated.0 -
and all that assumes the other driver is both insured and found to be at fault.
Being drunk & drugged doesn't automatically mean he is at fault and that particular sub section of society often have different spending priorities0 -

My car was stationary. Parked up. The vehicle was a company van and the fella has been charged.0 -
you were parked and the other vehicle was a company van so you can be pretty sure there is going to be no dispute about liability and there will be an insurance company to pay.
As quentin says, once your insurer has got their outlay back then you will get your NCB back and the claim changed from "fault" to "non fault" together with a refund for the adjusted premium0 -
