Its not a joint claim however it should have ALWAYS been a couple claim ! Youve been recieving the money wrongful as it was based on inaccurate circumstances0

Right, our situation is:
DH made redundant in June 2010, CB JSA claimed from June 2010 to Dec 2010
Dec 2010 - DH was asked to complete a JSA3 and was then transferred on to IB JSA - form was completed with my details also, I was told I did not have to sign on (even though I am seeking employment) as we had a dependent child.
DH was paid single rate, less £20.20 deduction for pension. His net rate has been £99.10 per fortnight for quite some time.
At the time of Rapid Reclaim on 24 Feb this year, the advisor told us we had to complete a joint claim - as explained, we did try to argue this but she was most insistent. She understood perfectly well that we had a dependent child at home so we're totally bemused by this situation.
His pension is paid annually and is a shade over £4000.

This has been wrong from Dec 2010 he should have been based on a couples basic rate of £100ish per week (currently £105.95), less the pension.

It is not a Joint claim it is just a JSA1 IB claim which includes his partner and children on the claim, it would only be a joint claim if they give you an ES40 and tell you both to sign on each week, you already said this is not the case, so we know that it is not a joint claim, it cannot be joint when there are children.
His pension is paid annually and is a shade over £4000.
£76.92 per week

He should be getting £105.95 - £76.92 = £29
if the pension is £78 per week = £27.95
And he should have been getting this since Dec 2010 so he has been over paid for the whole of 2011. He will not have to pay it back if he supplied all the relevant information and the mistake was entirely theirs.0 -
are you working now? if not, when did you stop working?
any claim for income related benefit is worked out on household income, so both his pension and your wage would have to be taken into account.0 -
Thanks very much for this info - all very enlightening. They have always been in receipt of all info, esp that relating to pensions, P60's, the lot. I dont know how they could have got this so wrong. Presumably, as they have lost our original claim, they are only working the RR in from the historical data of our last payment. Hence, they probably have no idea why he was paid £99.10 per fortnight but have just amended it to reflect the correct situation now (from the sound of the advice here).
So, I guess now we know the right amount is being paid, we need to bite the bullet about the fact we have 'lost' approx £22 per week and move on.
Incidentally, I have not worked since we lost our limited company in Jan 2010 (I was an employee of our company). I guess that doesn't make any difference to the sums though...

You probably could have claimed your own JSA Conts back then. You are probably too late to qualify now but if you want to find out there's no harm in trying....make sure, if you are going to do this....... that you ask for
JSA contributions based at the start of the phonecall when you phone "new claims"0
