Taxi drove into the back of me grr

I wonder if anyone would be able to offer any advice please?

At the beginning of the week whilst driving to work a taxi bumped into the back of me.

I was stationary with break lights on in a long queue of traffic. A few seconds later I looked over to the clock to see the time and the taxi bumped me which has caused a bit of bumper damage and until the repairers take the bumper off cannot conclusively say if the cross memeber has been bent (though he said it didn't look like it had).

The other driver said she didn't see me because she had the sun in her eyes.

I have also ended up with a neck injury (great not!).

Does anyone know how long it will take for the claim to be settled? I'm with Axa and she's with Aviva.

Also Axa won't renew the insurance which is due April1st and I will expect to lose 3 years NCB (currently have 4.5 years) how do I get compensated for this if at all?

I've never made a claim before so no idea what to expect.

    First mistake was claiming the loss on your insurance.
    You should have claimed from the liable party.

  • You need to make a claim against their insurance and you won't lose your no claims bonus.
    Thinking critically since 1996....

    You wont lose your NCB anyway, if it goes, it will be returned once the claim is settled.

    You have done nothing wrong.

    Thanks McKneff. i don't really understand the insurance minefield. All I know is it's something I have to buy to keep a car on the road lol.

    It's not too late if you haven't taken your car to the specalist repairers and haven't got a replacement hire vehicle from them.

    However you need to have the other person's insurance policy number so you can ring up Aviva first thing tomorrow and sort it out with them. It's cheaper for the third party insurer, Aviva, if you go to them directly. Then you can contact your own insurer on the telephone then following it up in writing, and telling them not to go ahead with the claim.

    However a few people have had issues with going straight to the third party insurer as insurance companies have different policies on parts they use for a car and repairs they do.
    I'm not cynical I'm realistic :p
