in Credit cards
I had taken out a Halifax credit card online in September 2006.
I know there is a lot of people asking about missing prescribed terms in order to deem the agreement unenforceable!!
When I read through my original agreement I have noticed the following;
a) Lender has failed to sign and execute the agreement
b) No credit limit is being shown
c) No information regarding payments - all it mentions about is
missing payments thats it
Is this enforceable or not and are claims still going through!!
Thanks!!

Is it enforceable, yes
Are there claims going through, not many as they have been closed down by MOJ but there are still some scamsters out there trying to take your money.
Did you spend it, yes
Do you still owe it, yes
Even if it is unenforceable you still owe it and you would not get credit, a mortgage, a rented property or some jobs for at least 6 years.0 -
For info - nobody needs to sign, you or them. Payment of any demand signifies acceptance by both sides. The Credit Limit is variable so does not require to be shown, similarly payments are dictated by the borrowing, and will be shown on the statement.0

It never ceases to amaze me that people come up with all these ideas such as not "signing" a lettter (simply typing their name) etc etc and believing that it has some sort of legal significance!0

What they forget is banks have copy cheques, card slips where signatures have been used, oh and application forms, previous letters etcDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0

I believe that any agreement signed in any colour other than blue or black, cannot be enforced.0

I never received or signed any documentation whatsoever for my Tesco and AA (MBNA) credit cards. A few clicks of the mouse and that was it, card arrived about a week later.
So I guess I can have a spending spree now and then say the agreement isn't enforcable, but I value my credit report, so I will not.0
