Freeholder rejecting variation to lease

We are having a nightmare selling our property because of a restriction in our lease on letting the property. After our sale fell through our solicitor contacted the freeholder to advise them that the restriction was problematic for us and asked whether they would agree to vary the lease. They did, on the basis that we met their costs – which we were happy to do as it meant being able to sell our property.

We received the initial draft of the deed of variation last week and it was insufficient. My solicitor then sent through her amendments and the freeholders have refused to accept the amendment.

This puts us right back to square one and will result in us losing our buyers again. We’ve paid £550 to fix this issue (which now isn’t going to be fixed) and whilst waiting for the deed we’ve rejected an offer from another buyer (as we thought we’d be able to salvage our original sale).

I just feel like giving up with trying to sell our place :(

    I know that my solicitor has emailed them to say it's not good enough.

    Although I only know about all of this as I just happened to go on my solicitors online tracker and saw the email they sent.

    My solicitor hasn't actually contacted me to advise me about this situation - despite knowing full well that if this doesn't get resolved we'll lose our buyers again.

    Blood from a stone springs to mind.

    I can't even get my solicitor to communicate with me! I just tried calling her to find out what is going on and funnily enough she's not available (neither is her secretary).

    So they've got no incentive to sort this out for you?

    What have they done with your £550?

    My solicitor called me back and when I said I was disappointed that she hadn't bought this issue to my attention (she knew on Friday apparently) she told me I was unreasonable and that my expectations were too high. Apparently I'm not her only client - darn, where's that sarcastic smile icon!

    For every minute you pay her, you are her only client.

    And I think that she is something of a lazy cow. As I think it goes, I would have expected her, on your behalf to have drafted the variations rather than let the freeholders solicitor do it. Perhaps one of the solicitors here would overlook the words lazy cow and comment?
