Exel Parking FINE

Being a responsible Driving Instructor, Grade 6, about 2 years ago, and I can give an exact time and date, I was asked by a Pupil to be dropped off nearer to his place of work in Wakefield. We approached his place of work but found it quite congested, with various hazards and main road traffic lights, so I asked him to drive into a Car Park so he could get out and therefore be a little safer than exiting on a main road. I left the car park about 3 minutes later without a thought. the next day, the same thing happened, I was maybe 4 minutes within the car park but had not intgended to stay or park in a bay and leave the car unattended, due to my next lesson being within twenty minutes and a fair distance away.
About 3 weeks later I had a ticket from Exel parking demanding a fee of £65,00 and the day after that, another ticket demanding £65.00. I wrote to the company and continued to write and refuse to pay for this extortionate fee. They have since said the fine has gone up to £120 for each occasion. I will go to Prison before I pay this. I will not budge, UTRINQUE PARATUS, for those who dont know what this means, READY FOR ANYTHING.:A

It's not a fine, only courts can impose fines.
But, by identifying yourself as the driver (which you were under no legal obligation to do) you have made it easier for them to prove that you are party to a contract and that the fee is part of that contract, which was explained on signs in the car park. It's a weak case, but not as weak as one with no evidence of who the driver was at all.
I'd ignore anything else they send, short of a county court summons.We need the earth for food, water, and shelter.

Is this the car park at the junction of George St and Kirkgate, enforced by ANPR cameras? There is no barrier at the entrance and no possibility of reading the small print on their signs as you enter. How can you be considered to have have entered into a contract is such circumstances? What would happen if a driver entered the car park, found it to be full, and left? Is there a minimum time between entry and exit, before they can charge you?0

Going through the motions with them myself at present. Circumstances are a little different, HERE'S the link for the thread when I posted about them in January. Have had 3 letters warning me that there'll will be increased costs due to solicitors fees, and that it may result in sending Baliffs (sic), you'd have thought they could spell Bailiff properly wouldn't you? The last letter I had was a week ago saying that if I didn't pay up within the next fortnight (the charge has now escalated to £100) it would result in court proceedings. I nearly weakened, but decided if they want to take me to court then I'll let it go that far. I've got photos proving there are no signs on entry into the car park in question, and what signs there are were not obvious nor did they look like parking signs. Keeping my fingers crossed that they won't take it that far (got enough stress in my life without it!). Unfortunately, on receipt of the "invoice", I did send an email saying that it was issued unreasonably (I've re-read my email and haven't used the word "appeal", just that as it was unreasonably issued so I'm not paying it). I regret having sent anything at all now, having read everything after sending the email. If I get clobbered with court proceedings, I'll let you know!

How do they know whether or not you even bought a ticket when you went into the car park?0

This ticket is an unenforcable scam.
It is not any sort of fine.
OP - Get yourself over to the parking board to see any number of threads advising the best course of action for dealing with these jokers - Which is mostly IGNORE!
And in the forum Sticky, you will undoubtedly find an example of Excel's letter chain, so you can prepare yourself for the various forms of toilet paper they will send you next.
So do stop getting so worked-up about them, OK?0 -
Ignore until they send a court summons, then watch them get laughed at by a judge.
Better still, buy a hamster and a shredder, and use the paperwork they send as free bedding. :money:
