Eon breach of data protection act

Me and my oh used to have an account with Eon. When we changed to Scottish Power they messed up on the meter readings and have been chasing me/us for the amount 'owing' ever since, despite the fact that it was an error on their part and they refused to resolve it with SP.
Our previous account they messed up with the names - i.e. we are Mr X and Mrs Y Jones and they always addressed us as Mr & Mrs Xy Jones.
Last September me and my oh split up due to domestic violence and I had to change all my phone numbers as he was harrassing me.
The other day Eon came knocking on my door offering a cheaper deal and being a supplier !!!!! I went with them. They couldn't find a record of me on the system and were actually looking for the previous tenant. I gave them my details, my email address and my new phone number.
Yesterday I got a letter from them addressed to Mr & Mrs Xy Jones, which I ignored initially. When I checked it they had written to confirm my new order with them, with my oh's email address and my new phone number. As this is an online managed account i am terrified they have emailed him with my new details, never mind they information they have for my account is totally wrong.
If they have passed my new phone no to my oh can I sue them for breach of data protection?

You can sue them for having a red logo. The more interesting question is whether you get anywhere.
In your position, I might be more bothered about establishing what breach of data has occurred and getting that fixed and worry about compo to pay for it later.

Agreed - first things first. You need to find out exactly what information they have sent to your ex partner first. Then, if need be, you need to change your phone number.
Then sue them.0 -

Are you still at the same address? If you are, I suspect we've attached the new account to the old one by searching with the meter serial number or meter point admin number (both unique to the property). This can soon be put right. Please contact us asap so this can be changed.
Concerning your online account, did you register with our website when you came back to us or continue with an old registration?
If it's a new registration, then you'll have needed to enter your new email address and this is what we'll use.
If you're using the registration previously used for the old account, have you changed the email address attached to this? Only customers can do this and you'll have needed to log in with your username and password.
This should have been explained to you at the point of sale and I'm sorry if it wasn't.

If you are, I suspect we've attached the new account to the old one by searching with the meter serial number or meter point admin number (both unique to the property). This can soon be put right. Please contact us asap so this can be changed. - i am at the same address but nobody checked my metre number
Concerning your online account, did you register with our website when you came back to us or continue with an old registration? - I opened my new account with a door to door salesman and was told that as part of my account I would have online billing
If it's a new registration, then you'll have needed to enter your new email address and this is what we'll use. - I assumed the salesmen would open a new account with the new email address I gave them

This should have been explained to you at the point of sale and I'm sorry if it wasn't. - when i spoke to the salesmen, they couldn't find my previous joint account on their handheld pad thingys

I have contacted Eon and the customer service agent I spoke to has opened (and closed) a complaint and has taken all my phone numbers off the account. She has also told me that the account has not been accessed since last May and that no email has been sent to my ex. However I find that hard to believe.
As the previous account was a joint account, at no point when setting up the account with just my name, a different email address and a different telephone number, should my new account have been linked to my old account. Do Eon not allow for people splitting up from their partners?
I'm still extremely distressed by all this. I will be contacting my solicitor for advice.
I have now cancelled this new sale as I have lost all confidence in Eon.
On a positive note howeever the CS I spoke to was extremely helpful and understanding.I'm playing all the right notes, just not necessarily in the right order!0
