Asian Sound Radio Making me ill!

Hi All,

Asain Sound Radio were conducting an Asian Lifestyle Exhibition and offering stalls to allow exhibitors to promote their companies. I am a freelance makeup artist and after much thought decided to go for a stand. The deposit of £300 was paid 27/10/11.

I booked time of work and re arranged some shifts with some colleagues as I work in retail for the exhibition which was due for the 4th and 5th of February and my husband also did the same.

I booked 2 models and all was going well until I got an email on the 21st December saying
Hi.

Hope you okay, it’s just to let you know that we have changed the dates for Asian Lifestyle Wedding & Fashion Exhibition 2012.
We hope these dates won’t make any difference.
Wish you best of luck for the Exhibition!
Best Regards.

I contacted them straight away as they did not even mention the new dates or a reason why. They first told me it was because they expected bad weather at that time, they then said it was because it was double booked and then they said it was because they needed to get more bookings first.

The new dates they had given me were 25th-26th Feb and it was impossible for myself or the model to to make those new dates. I emailed them and asked them for my money back and they never replied so I called them and have been calling ever since. I am getting answers like

The director is not in so we can’t help you, there is no point you coming here because nobody can help you.

Once I was told 'why do you keep calling? it's only £300! You will get your money!
If you keep calling it's going to get us angry and then the chances of you getting your money are going to be slim.
Then I got an email saying 'we will refund your money after the exhibition'.
But again nothing. So I called them and he said a cheque has been posted but I received nothing.

I have called and called and now they just say stop calling the director has your number and he will call you when he comes into the office (which he never does)

Please help as I do not know what to do anymore! I want my money back but I can't afford a solicitor.

Thank you

Hello. You need to contact Trading Standards - go to the Consumer Direct website and phone the number, someone will ring you back. I would write to them and formally ask for a refund. Send by recorded delivery. If you paid by credit card you can do a charge back. If you had a written contract you need to look closely at the terms and conditions, but changing the date is a major change so I would expect that you are fully entitled to a refund.

Send them a letter before action and if they do not give you your money within the 28 days you mention in the letter, take them straight to small claims court. Kepp all records of what you paid, when and all comminucations.

They're currently advertising their Asian Lifestyle Wedding & Fashion Exhibition 2010 as "Coming Soon" on their website, so I wouldn't hold your breath. :)

To be fair, Asian Sound Radio appears to still be going, but their website and Twitter account appear to have been abandoned sometime around 2009/10.

Sounds like they don't have £300 to refund you with, and nobody else wants to book their fair. That's the risk of being a promoter, and their problem. Letter before action as above, this will help them focus on who to pay first if they're scrabbling around. Carry on to small claims court if needed - again to focus their minds.

After all, if £300 is no big deal, why can't they refund you on the spot?!

How did you pay the deposit? If it was by Credit Card, can they help you?
