They Took My ESA Away

    This time last year, after being on Incapacity benefit for 2.5 years, I received a medical and said I was fit for work. I never appealed it and just accepted the decision as never had the strength to fight anymore. So for the next 6 mpnths I was receiving JSA. I was advised by my social worker to reapply to the sick benefits and I was put on to ESA. Which I have been receiving ever since. 3 weeks ago, I went to a medical and was told today I no longer qualify for ESA and will have to claim JSA again.

    Where do I stand here? Last Wednesday the doctor wrote me another 8 week sick line to send to the benefits office to keep recieving my ESA payments. Which I sent to them last week.

    If my doctor says that I am not fit for work, how can they put me on JSA?

    I suffer from tourettes syndrome and also have depression. Because of the depression, I drink heavily too. Thanks

    What your GP thinks is one thing, what you are assessed as being capable of by ATOS is another.
    Failing two assessments AND being able, willing and fit enough to claim JSA for 6 months all within a year should be telling you something. Maybe you are more able to work and/or look for a job than you or your GP/social worker think you are.

    To comply with the what is thrown at you whilst claiming JSA and having agreed with the Jobcentre that you are fit and able to work at least 16 hours a week doesn't to me sound like someone that is incapable of doing any type of work for which you would get ESA.

    Finally got my letter saying my Tribunal is set for Janurary 26th. Which is almost 1 year. My representative will be representing me on the date. I am kinda nervous and scared to also go to it. Will it make a major impact if I do not go to it?



    You said on your post yesterday # 40 that it is your tribunal today - today is the 23/01/2012. I hope you have not get mixed up, if not ignore this.

    Have you been asleep for the past 12 months?

    Unfortunately we are now in the year 2013!! You haven't missed anything exciting.

    Never thought I would say it but - thanks for that Andy. It will take at least till end of February 2013 for me to 'catch up'.


    Just hope the OP got the date right...even though I didn't!

  • lol dont worry. Tribunal was today and they told me that they will write to me with in 5 working days with their outcome.

    Don't worry about it, I can't even remember what the date is or even the day of the week! All I do know is that 'bin day' is Friday, and the neighbours put them out on Thursday night so that helps.
