If this was the other way round no one would be giving the OP grief! Just show how this is so totally biased against the 'absent' parent. Lol absent yet the OP has the children 3 days the ex has them for 4. Almost 50/50 yet op is called 'absent'......

He's supposed to be called the "NRP" or non-resident parent.

Don't forget that nobody knows the ins and outs of anybody elses relationship break ups either, so the posts should be purely to help or clarify a situation, not to judge.

As the product of a "broken home" myself, I would like to think that I have sought to clarify, not judge. The OP has certainly made a mistake by not reporting his changes when they happened. That does not make him stupid or a careless "couldn't care less" parent. Whether anything can be done to rectify the situation remains to be seen - I hope he keeps us posted.

They do say all is fair in love and war. Yes, I agree, if an ex has money that they are not entitled to then it should be repaid. If your employer paid you twice one month then they'd be right to ask for it back.

Yes, good analagy, however, if your employer overpaid you & you hadnt realised (it was a small amount or something!), then two years later, tried to reclaim it........but at this point you didnt have it spare? Wouldnt you be mad with your employer? I think, I would be giving my notice!

Based on this case, rustyarchs is saying, ok i messed up, i didnt notify the CSA,& because of that, 2 years down the line i realise ive paid more than i needed too!! my ex knows nothing about any of this, but now Im going to ask her for the money back! Oh, not only that, but someone on here, Ex- CSA employee, has told me how to try to con the system, so Im going to lie in order to try to get my money back!!!

Sorry guys, there isnt anything to debate here! Its called, taking responsibility of your own actions! Rustyarchs has no legal entiltlement to claim any of this money back, because regardless of anything it was his responsibilty to inform the CSA of a change in circumstances! HE CHOSE NOT TOO!!!!!!!! Nobody, should expect , someone else, to take the brunt end of their mistakes. He messed up, its for him to deal with! Period!

FGS!! give the bloke a break  did you read his opening post at all ?

thing is i was suffering depresion and my life was a total mess partly due to the job and the also due to personal issues

He would be seeking the payments back from the CSA, exactly the same way many PWC are seeking child support and are still waiting for.
I think perhaps it has been mentioned before but if the mother was on benefits it would not come from her but from the secretary of state.
The CSA is a complete and utter shambles the left doesn't know what the right is doing hardly conning the institution is it.

  • i hope you won rustarches, after a bitter divorce lasting 2 years £12k in legal fees and letting my ex walk away with £250k from the last house she still tried to screw me for every penny i had not to mention poisoning my children against me! spent last year paying £50 a week through the csa originally offered her £250 cash a month to leave the csa out of it but she thought she could get more using the csa, she lost! and now due to my self-employed income she only gets £5 a week lol, and on top of that she has to repay me £350 in overpayments which i am using to take my girls on holiday! DO NOT feel sorry for them!! my ex gets £12k a year for sitting on her !!!! from tax credits plus the money from her job plus maintanaince i have the girls foe nearly third of the year and no body pays me a penny so how is that fair!! I hope you got every penny back you where owed and i am sure like me you life is complete and happier without her all you need is the love and trust of your children x
