CSA overpayments

got told by a workmate about this site (hi gordo lol) as i didnt know where else to try

my situation is that i left my previous job (security guard working 63 hours a week talking home £252 pounds a week) just over 3 years ago and started another one on november 11th 2003 (labourer now working 38hours a week and i started on £180 a week but now after 3 yearly wage rises im now up to £199) thing is i was suffering depresion and my life was a total mess partly due to the job and the also due to personal issues so when i swapped jobs i never botherd getting in contact with the CSA as tbh i thought it was more hasstle that i didnt need so just kept making the same weekly payments!!

iv just had a review done of my arrangement to the CSA and been told that due to the fact i have shared access as i take the kids wed nite and over the weekend and that my wage is so low i dont need to make any payments, now i have no bigger bills and my mortage is just the same as it always has been and nothing has changed from my original agrement other than my job.

i asked what would happen to my 3 years payments (roughly 5 thousand pounds that i figure i shouldnt have been paying since i started my new job) but the lady on the phone told me that as i hadnt informed them of a change then that money doesnt count and only counts when the date of the review has been started:confused:

so does this really mean i have lost the 5 thousand pounds that i have been overpaying as that is nearly half a years wage to me and would make a big difference to my life ??

    I wonder what the outcome would have been if you had UNDERpaid for the last 3yrs!

    I bet it would have mattered then.

    The CSA are essentially correct. If you do not inform them of any changes they are not obliged to back date. In the past this has worked both ways as they have been so busy they were only interested in chasing you after regular revues. Whether or not this is how its supposed to work is debatable.

    Your only hope now is to make a written request that they backdate your case based on a change in your circumstances. You will need to provide proof of what you say IE wage slips, P60's, any contract you have. And explain about the stress you were under at the time as a reason for not telling them sooner. This is a long shot but is the only thing you can do right now.

    Please be aware that they may revue your case and work out that you should have paid something. From what you have said it seems likely they will not, but you do need to realise that you may not simply get 5k back even if they do a new revue.

    £5,000 - just for the sake of a phone call or letter.

    You haven't a hope of getting it back, that's for sure.

    No I didn't mean like that. If you had informed them of your COC at the time, they would have reassessed you back then.

    It's another flaw in the system. If they got their act together and because you are salaried, in my opinion, it would not be hard for an alert to be placed between IR and the CSA automatically when an NRP's income changes. Linking the two, so to speak.

    I didin't mean my posting to be nasty in the slightest. You clearly explained you have shared access.

    No, essentially.They should but they don't. They are too busy being incompetent.
  • My other half over paid for years and didnt get any of it back. He was reassessed from 90 a week to 0.
    They add on any arrears from a change in circumstances you dont tell them about though:(

    My ex has underpaid me for the last 3 years. However, I earn a pretty decent wage myself and know that if I push him for more money he'll just give up working! Its really bad that people find themselves in this position.
  • right this may sound bad, but i want to help..
    i used to work for the CSA (hides) was there for 6 years, now let me say that if you had spoken to me on the phone i would of done my best to see what i could do for you regarding the 3 years arrears..
    i dont know whether i am allowed to say how to cheat the system and if this post gets deleted then so be it but may i recommend that you ring them and say that you did inform the agency.. it was august 2004 when they had the ability to document telephone calls on the new system data base. so who knows what happened before that date. also mention that you sent in the details to them.
    in my experience its easier for the csa member of staff to just take your word for it and give you the benefit of the doubt.
    Of course if they do believe you and do wipe out the arrears then your ex partner might be a little miffed, but depending on your relationship with her she might not be too bothered.
    any way, i've just registered on these forums to give you this advice, normally i would say anything but reading your story at the beginning of the post i couldnt not say anything
