You must hate the CSA as much as we do. What you've said probably isn't allowed but I'm sure some folks on here will give it a go. Good luck anybody who decides to give this a go. Personally speaking I can't fault the CSA. They dealt with me and managed to get me some money. I had no choice but to go to them as my ex was being really difficult and gave me no money for nearly a year. Whe he was assessed by the CSA I wrote off the arrears he owed me as I'd technically lived without the money, and we've agreed a sum each month. It's less than the CSA have told him to pay, but its enough for me to live on.

I do appreciate that many many people are not quite so lucky as me and hopefully will take on board what you've said.
  • By all means i didnt want to give anyone a way round the system, my advice is obviously geared towards anyone who has done what the CSA has told them too and is still getting screwed over by them. the CSA does do its job, unfortunately the cases which do work well dont sell newspapers.
by the end of my time there i did hate it but that was because the system didnt work properly and i was being verbally abused by customers through no fault of my own.. if someone is going to shout and swear at me then i want to feel like i've done something to deserve it
  • Hey come work for the NHS. The verbal and physical abuse is op notch. We've all been on violence and aggression training and that's just to deal with the patients who we are trying to help.
  • Rustyarchs - It was your responsibility to inform the CSA of any change in your circumstances, on all the letters you must have recieved from them, it would have said that to you! Bascially, you couldnt be bothered to put in a call, so on the back of that, your now worse off! Well, learn from it & next time it happens, pull your finger out!

As for trying to claim back £5,000 from overpayments?! Are you joking?! So your saying, that because of YOUR incompetence, you would be willing to put your ex partner in debt for 5 grand? Which, is in essence what youd be doing, if you followed the person who worked for the CSA's advise.....If I were your ex & you tried to claim back three years worth of maintenance, Id be livid with you!! Take my advise, drop it & learn from it at least for the sake of your child(ren).
  • well cheers for the help and support everybody il try and do an appeal and see what happens and post on here as it seems that going by charliecats post there may be many others in my shoes

mystery07 you really dont have a clue of my situation but your post made me laugh for the first time this weekend so thanks for that lol....all the letters?? my case went like this with the CSA - 1 letter telling me that the csa were involved to which i replied then a phone call to arrange a house visit and everything got sorted out at my meeting and im sure i maybe got a letter confirming my amount to pay and that was it,iv never had any hasstle paying any money to them in fact iv never missed a payment!!

oh and im not joking about claiming it back after all you say its due to my incompetence over my own money but is that not what this forum is all about? iv read threads on here about claiming back bank charges but surely the bank would have mentioned them?? the fact is it happend to people due to one thing or another but that doesnt mean its right!!! and in my eyes me paying £5000 when i shouldnt is def not right!!

    thanks again
  • Well as i said try what i mentioned before, say you did ring and sent the information in when you started your new job.. what are they going to say... "no you didnt" i dont think so

    Good luck

There is a big difference between re-claiming bank charges & re-claiming maintenance. Up until recently, nobody, actually realised that bank charges were unlawful, so nobody stood up & did a great deal about them! Now the consumer action group, has made it public knowledge, people are doing something about it...The information was not in the public domain....

This site is not about people's incompetance...."Consumer revenge" is its slogan....ie screw back the big corporations, that have gotten away with screwing us for years....What your talking about is screwing over a person, & not only a person, but the mother of your children, because you couldnt be bothered to put in a call to the CSA yourself!!

So what, in essence you want to do, is put your ex in debt to the CSA because of your mistake...That is, i assure you, the exact opposite of what this site is about.....People, who have gotten into debt, are on here trying to do something about it....hey perhaps if you succeed with claiming back your £5K you could reccomend MSE to your ex, she could become a debt free wanabee?! Quite fitting, dont you think! What your saying is immoral & unjust....I hope you fail miserably

It is common sense, whether you have letters or not, to tell the CSA about any change in your circumstances....this isnt rocket science

reclaiming back bank charges and reclaiming back payments made to the CSA both have one major thing in common you seem to be missing out on in your first paragraph- they both invole money paid out that should never have been paid in the first place!! this really is all i need to argue because no matter what the reasons were, the facts remain that it is a sum of money that should not have been paid out

as for your second paragraph- is it not?? surely if people were competant with there money people wouldnt go bankrupt and if able to balance what they earned and what they spent then nobody would go overdrawn in the first place thus leading to no charges to claim back?? im all for screwing the big corporations but then again i live a simple life with a very modest car and house my only debt is my mortage,i never spend beyond my means but that is the way i was brought up by my father so please kind sir dont lecture me about being to lazy to make a call at a certain time in my life because going by your signature of being in debt im not the only one who has done something that could have been prevented, then again i dont know your circumstances so who am i to judge

third - this is the only part i really took notice of as its true-"hey perhaps if you succeed with claiming back your £5K" -your right it is MY money, money that i gave out when i didnt need to, money that i would like to claim back, the rest being rather poetic nonsence that nearly brought a tear to my eye so bravo but i dont think i need to dignify it with an answer as iv got a funny feeling you will just dig deeper until we are argueing about what is right and wrong about the war in iraq or some other cause that you feel the need to bring into this to try and give a very simple situation some meaning

i had just went through a very painful time when my marrage had broken down, i had to leave my house and my kids and all i had worked for to move back in with my mother until i had got my head sorted out,i left my job to try and start afresh trust me it was heartbreaking, and amongst all this you think think i nothing more important on my mind than to phone the CSA:rolleyes: your having a laugh

i hope something like i went through never happens to you as it would be a very painful eye opener.... however something about how one sided you are in defending the CSA and the money iv lost makes me think that perhaps you are bitter towards me?? you wouldnt be receiving maintenance payments from the CSA yourself would you?? as if you are then i can understand why you seem to think im the bad one for wanting my money back!!
