Very unhappy with ebuyer!!!

Hi all,
Just something to make people aware of with ebuyer...
If you buy something and set a delivery address and then use paypal to pay then there is a stupid little line in their T&Cs which says they reserve the right not to post to an address not registered in paypal.
There is no indication of this in the checkout process and I entered a delivery address (at work) and my home address for billing.
They claim it's my fault for not reading their T&Cs (who does?!!) and as a result an item I paid a premium price for next day delivery I have to collect from a post office... :mad::mad:
I bought something from dabs.com last week the same way, I used my work address for delivery and paid by paypal. They sent it to my work address no problem at all.
Ebuyer - get your act together!!! Tell people during the purchase process if paying £6 extra for delivery if you only deliver to an address in Paypal. :mad:
I've complained but their attitude is that the customer was wrong...great customer service, no recompense at all. :mad:
I didn't have chance to read the dispatch e-mail either as my PC wasn't working so couldn't check until the next day anyway...

    You can't really moan you were too lazy to read the T&C's - most people don't, but that doesn't give you the right to moan about something you agreed to!

    But surely they could have stated this information in the purchasing process, considering it's a change in where the item was being delivered to. I bought an item from Dabs.com through exactly the same process and had it delivered fine to a different address. It seems flimsy that such a company would make it some tiny line to read through in their masses of T&Cs. If you see their T&Cs just like with many websites, there's tons to read. You would assume that if you enter a different address under 'delivery address' that would be the address it gets delivered to. They should have something flag up when you choose paypal as a payment method to alert you to the fact they will only send to the address in paypal. I'm sure ebay does that, people will tend to indicate if they will only post to the registered ebay address.
    They have taken my comments on board though as they did say that other people had the same thing happen.
    It was a rushed purchase really, I didn't have time to read much into it as I assumed entering a delivery address was a simple concept, that it couldn't be disregarded due to a payment process.

    It's far too straight forward to just say that because it's in the T&C you can't complain.

    T&C are usually huge & companies are aware that most people don't study them all when they're making a simple purchase so they hide terms there. If there is an important term such as this then they should make it clear at the checkout process.

    The seller is bound by Paypal's T&C to send to the Paypal registered address. If something goes wrong (e.g. your item didnt arrive) the seller would automatically lose the case if they had sent to a different address and buyer would be reimbursed at the seller's expense. Seller's have to toe the line on everything to be covered under Paypal's T&Cs. It puts sellers on the spot when they get asked to forward to a different address - damned if they do, damned if they dont.

    Thing is though that I bought that item off Dabs using the same checkout process with paypal as the payment method and it was just that, a payment method the same as a credit or debit card. Dabs acknowledged that I had entered a different delivery address for my order. EBuyer had the delivery address I wanted as I had stated where I wanted it delivered when I ordered it. They should amend their checkout process if they can't deliver to that address as by submitting my order I was totally unaware they didn't intend to send the item to that address based on their payment system holding a different address to me.
    I can see reasons behind it but I didn't have time to read through tons of small print to discover the one small line which says:
    "(8.6) Please be aware that if you are using Paypal as your payment method we reserve the right to not ship to unconfirmed addresses."

    'We reserve the right' not saying that's definitely the case as in shops say 'we reserve the right' to refuse xxxx etc.

    So all the people on here saying I should have read the T&Cs, do you read through them all for every item you purchase? As BlueAngelCV states they're usually huge and companies don't expect people to read them..

    To me, stating a delivery address to a company and then making payment for it would suggest they would deliver to the address you asked them to or state before completing purchase that they are unable to.

    If you bought some furniture from Ikea and stated where you wanted them to deliver it and they took payment but then find out they delivered it to another address as they don't deliver to the area you wanted it delivered to (it's in the small print), would you not be a bit annoyed??

    Fair enough the company has covered themselves by including reference to it but I would consider the location an item is being delivered to to be a crucial part of the checkout process and have never had this issue before buying stuff online.
    I would have expected it maybe to make the connection as such to refuse me using an address not registered in Paypal.
    I just checked Paypal as well and except for the building name for my workplace, the address is actually registered to my paypal account...

    It may well be on the account, but it doesn't mean it's the confirmed address. That's usually your home address you entered when you set the account up.

    There lies your problem, it's certainly not their fault.

    Whenever there is money involved I make an effort to read the T&Cs, which could just as easily state; "We reserve the right to keep your money and sell the item to another dupe.", who's fault do you think it would be had I lost out for not reading that clause?

    Fault is irrelevant, that'll fall foul of unfair terms legislation? :)
