barclay loan rejected again

hi all

got two loans rejected by barclays today. These claims were reopend as I asked them to re- consider but failed again looks like its time for the FOS unless someone would be kind enough to help or advise thanking you.:(

    Need a bit more info to help really. What the reasons you gave for the claim and what reasons have they given for rejecting?

    I had 4 complaint with them 2 were upheld these were loans taken in 2001 and 2002. the two loans that were rejected was for loans taken out in 1999 and again 2001.

    the rejection states there was no evidence of any miss selling basically its just a generic letter they send out.

    All my loans were taken out when i was full time with 6 months full and half pay. why they upheld two loans and reject 2 i really dont know. All the loans were taken in the branch.

    my argument was why reject two but uphold the other two. whtas the difference:(

    were they big pay outs on the ones that paid maybe they were under the auto pay out limit?

    Or ask them to prove the reasons these were not mis sold and ask them for a copy of the agreements that they used to prove these were not mis sold.

    In our previous letter, we promised to contact you when we had completed our investigation into your complaint.
    My understanding of your complaint is that you feel you were mis-sold the Payment Protection Insurance (PPI) policy.
    I have conducted a complete review of the sale looking at the following factors:
    • Whether you were eligible for the Policy taking into account:
    • your age
    • your residency status
    • Whether the Policy was suitable for you taking into account:
    • your employment status
    • whether you had any pre-existing medical conditions
    • any existing savings/other insurance products you may have held
    • whether you could afford the policy
    • Whether the defined sales process was adhered to and all relevant features disclosed to you including:
    • that you were made aware that the Policy was optional
    • that you were not pressured into taking the Policy
    • that you were advised of the price of the Policy
    • that you were informed of any significant exclusions
    • that you were not given any misleading or inaccurate information
    In order to reach a decision, the information I have used will have included the following where available, but is not limited to:-
    • All the information you have provided me with
    • Your recollection of the sale
    • Copies or transcripts of phone calls (where they exist)

    • Relevant internal procedure manuals that were in use at the time of your sale
    • Training material that sales staff would have completed
    • Our internal compliance monitoring and audit reports
    • Sales statistics and complaint records associated with the person who sold your policy
    After taking all the above information into account, I am unable to find any evidence that the PPI Policy was mis-sold. Therefore I regret that I am unable to uphold your complaint.
    This is my final response to your complaint and I need to make you aware that you now have the option of asking the Financial Ombudsman Service to review your complaint.
    I have enclosed a copy of the leaflet “Your complaint and the Ombudsman” published by the Financial Ombudsman Service. This explains the procedure should you wish to refer your complaint to the Financial Ombudsman Service, you must do so within 6 months of the date of this letter.

    is it still worth asking for agreement and evidence for their reason on why they think i wasnt missold. please help

    What reasons did you give for mis sell originally?.
    Did you have sick pay when you were off work to enable you to pay the loan, do you have life insurance and was the ppi put on the loan balance and you paid this back over the term with interest one payment each month for both loan and the ppi?.

    it was two loans

    loan one in 1999 for 1000 with ppi of £98

    loan two was for 10000 with £1772 ppi

    was working full time 6 months full and half pay.

    reason i gave was the first loan was my first loan with barclays and tols as i was 21 this would improve my score.

    second loan again told had to take this ppi so i did. my other two loans that were upheld were taken in branch in the same way so im confused why they didnt upheld all my 4 loans

    Get back in touch and ask them for the proof that the ppi was sold correctly to you, let them know that these ppi were put on at the start of the loan and you paid this back over the term with interest, this is front loaded ppi, and ask them to reconsider the rejection, or you will pass these over to the FOS.
