debt over a 10 year old over-draft!?

Today i have received a letter from a debt collection agency, Buchanan Clark & Wells acting on behalf of Aktiv Kapital Uk Limited. I called the number on the letter, feeling very anxious and worried about what it could be about and an extremely rude arrogant and unhelpful man, calling himself Mr Smith, informed me that Lloyds TSB are chasing me for an overdraft debt of £300 from over 10 years ago that i remember nothing about at all! I said that i didn't have that sort of money, having a baby to support but i could pay £10 a month, at which the rude man laughed and said that i would have to prove that this was all i could afford and i would have to provide them with a list of all my monthly outgoings! Does anyone know what i should do?

if it's 10 years old the debt... you don't have to pay it... isn't there a limit ? like after 6 yrs they cant touch you ?• HSBC (Main A/C)

Thanks alot, i hope you're right but i dont really know. i'm going to speak to Citizens advice and see what they say. The thing is that i had an account with lloyds TSB when i was about 20/23, i'm now 36!0

Not used the site myself but friends have recommended it as a good place for advice about debt collection agencies and dodgy practices, and they seem to have a specific board for Aktiv

OP you should post this on the debt free wannabe board http://forums.moneysavingexpert.com/forumdisplay.php?f=76
They will be able to give you the right advice / point you in the right direction. I'm fairly sure that after 6 years of no payment or acknowledgement of the debt they can't chase you for it. The guys on debt free wannabe will have good advice on this and know all the correct ways of handling the debt collectors.0 -

Assuming you havn't acknowledged this debt for more than 6 years then it is statute barred. If you are contacted again regarding this debt just tell them it is statute barred and ignore further communication.0
