Perhaps it's just "where I am", here's an excerpt from somewhere else;1. The employee’s criminal record should be assessed in relation to the task they will be required to perform and the circumstances in which the work will be carried out.
2. Wherever possible applicants should be offered jobs unless there is a serious concern that their conviction will cause a serious risk if they are appointed to the role. If it is decided that an applicant is not suitable to be posted into a sensitive post then a non sensitive post must be found.

There is a difference between should and must. An employer maybe should do something but it doesn't mean they will.0
