    I could be wrong, but to be turned down doesn't whatever is on your CRB check have to be related to the job? Ie applying for work at the DWP and you have a caution or what not for benefit fraud = no job. If you were turned down because 10 years ago you got into a fight and were arrested surely you have some form of appeal?

    What kind of jobs are you applying for? Working at a womans shelter I could understand why they are perhaps hesistant to take you even if what's on the CRB was only an accusation...

    Subject access requests

    Individuals can obtain a copy of their full criminal record by submitting a subject access request to their local police force. There is a £10 fee for this service.

    That is not the same thing as an enhanced CRB, and may not contain the same information. And we are not even sure what the circumstances are here anyway. JasperMac hasn't answered any of the questions asked, so we don't know for a fact that this is an enhanced CRB, whether it definitely contains reference to this incident and he knows this for a fact, what kind of work he is applying for or whether this is the reason that he is being turned down for employment. Without some more information it isn't possible to give constructive advice

    An employer doesn't have to see a direct connection with the job in order to decide not to employ someone because of an entry on their CRB report. There is no formal right of appeal for any recruitment decision.

    So let me get this clear in my head. If you are charged with an offence and taken to court, but the court finds you not guilty - it sill appears on an enhanced CRB check?

    yes. there were cases in the past were abusers were activly abusing people but thy were never convicted. think of the caretaker cambridgeshire that killed the two girls.he was known but had no convictions.

    Actually, the answer is no not yes. Where someone has been charged and taken to court and found not guilty this does not show on an eCRB. The matter has been heard and concluded. Police intelligence is information about people which has not been subject to court proceedings, and does not have to be disclosed on an eCRB. Whether it is or not is a matter of judgement for the Police to make in relation to specific applications and their circumstances. The provision is, as far as I am aware, seldom used (and I see a lot of eCRB disclosures), and usually relates to instances where there is a real and apparent threat in police terms although there may have been insufficient evidence to charge and/or issues of rleiability or willingness of victims to testify. These are normally cases of chiild abuse, rape and domestic violence. But I have never seen nor heard of a case where a single uncorroborated instance of alleged domestic violence has prompted the police to use this discretion, which is why I am asking whether JasperMac is certain that this is the reason that he is being refused employment.

    Yes. But many employers haven't taken up references etc either when making a conditional offer. If the offer is only conditional there could be a lot of reasons suggest offers are withdrawn. Without knowing for a fact that this incident is the cause … and JasperMac seems to not too interested in coming back to clarify.

    Every CRB I have done, We get a copy and so does the employee.
