    by the tone of his messages he thought he was in the right, its only when l quoted what theonlywayisup said that he decided to send it but only after a load of abuse

    Because he didn't have to as an ebay case has been opened and both parties agree to ebay rules.

    Does the buyer have to return the original item? Who pays for return postage?
    The buyer must return the item to you to qualify for a refund. The buyer will pay for return postage. Here are the criteria for return postage:
    • Buyers must return the item using trackable postage with delivery confirmation, or risk not qualifying for a refund if the item is lost in transit.
    • If tracking or delivery confirmation is not provided by the buyer returning the item, and the item does not appear in a reasonable amount of time, then the seller is not obligated to refund the buyer.

    I know he doesn't have to, he also didn't have to refund until he received the item back. Refunding before he got it back means that he really had to pay for the return postage or lose the item.
