Who pays or who should pay?

Morally a seller 'should' pay if something is SNAD.

Are you the buyer or seller?

If you have opened the case, then you need to send it back tracked. If you haven't opened it yet, make sure when (if) you do, that it is an Ebay case. Highlight the fact you want the returns postage paying. Ebay cannot force him to pay, but they may give you a voucher/reimbursement to the cost or even tell you not to return it.

Unfortunately you cannot make a private seller pay the postage for the returns.

Once settled, you can remind him of your disapproval in feedback and stars.

There is no such thing as free postage, it is built into the start price or business model of the seller.

l did open a case and a few minutes later he had sent a refund for the item but minus any postage costs, and ebay closed the case, he is also very abusive in his messages

When you say 'he sent a refund....but minus any postage costs' are you saying that he hasn't refunded your entire initial payment?

You could take his words literally & send it back free, as in not put any postage on it if it will go into a post box.

no my fault l didnt make it clear, he refunded the cost of the item but didnt allow for return postage so l wasnt sure who had to pay for its return, and its quite a heavy item so not going to be cheap to return, he also used a stock picture if he a had taken a proper photo of the item theres no way l would have bought it, keeps banging on about what a bargain it was and what did l expect, but similar items in much better condition are going for around the same price l paid so l dont know what he means by that

As he has refunded, I would let him know you couldn't find any free postage, so you will let him arrange his own!
