Can I Get Out Of This Contract?
I'm 6 months into an 18 month contract with T mobile, from the start I've not been happy with it.
There has been a lot of problems with the signal, sometimes not getting one at all, most of the time the call cuts out every other word whether I've dialled out or the person's dialled in, usually one of us just gives up & rings when we're at home to use the house phone instead.
A lot of the time it says limited service etc.
A few weeks ago it was completely unusable for a couple of days so I rang them & was told the sim card must be dodgy so I would have to pay for a new one, I explained that I'd never taken the sim card out since the day I got it so I couldn't understand why it was suddenly no good.
Had a lot of problems with the phone aswell, it's a Samsung E820 (all Samsung camera phone's are prone to breaking) the camera no longer works, something to do with the hinge having the camera connection in it. I can get the phone fixed but doesn't seem much point when the signal is so bad.
Would I be able to package the phone up & send it back to them listing all problems & terminating my contract?

Contracts are difficult to get out of.
Is the signal problem just in your area ?, when i worked for Vodafone, we could check what "mast" the phone was connected to, so if the mast in the area is down/broke, they should be able to see that you haven't connected to the mast and hence not used the phone due to problems with THEIR mast.
In Vodafone's case we would give a good will gesture of your line rental for however long you couldn't make a call, nut i'm not sure what t-mobile's view is on that.
If it happens in more than one are, and with the other phone problems, you would need to take it back to where you got it and get it tested to see what the problems are.
As far as the contract goes, you are liable for paying the contract when the phone is being repaired and even if you don't have the phone you still must pay.
If it's really a poor service in your view and you know other providers have better signal then just pay off your contract and move to another SP. It will be costly, but unfortunatley that is sometimes the best way.
Those are the main options, T-mobile will not just let you send the phone/pack back and write off the contract.
Good luck.
P.S. Not being biast (spelling) i have had a faultless service from Vodafone for the past 10 years, i don't work for them anymore so i dont have to say that , but i've had no problems what so ever.0 -
Surely I could argue that I'm not getting what I'm paying for?
Like when you buy goods from a shop they have to be fit for their purpose? If you're going to stalk me, while you're at it can you cut the grass, feed the dog & make sure I've got bread & milk in

You paid for a phone that works and for a signal, so if the phone is faulty then they should fix it, if the problem still happens then they will probably give you a reconditioned phone (an old one).
In their eyes that would fix your phone problem (eventhough you would have a crappy phone).
Like i say if the signal problem is just in one area then their mast is not working properly and if reported they should get an engineer out to fix it, as mentioned i don't know if they would reimburse you if they do have a problem and admit it's their fault, but Vodafone would.
In your situation you would be best going to citizans advice and getting upto date with the contract terms, hopefully they will spot something and if you ring t-mobile with whatever C/advice say then they will know their not dealing with a mug and hopefully get everything sorted for you.
if you can find your contract, take 30 minutes out of your day and have a read of the T&C/small print to see where you stand.
Good luck0 -

A quick google found this, it looks like a basic contract, but it might be different from yours, give it a read.
